Carespring Health Care Management LLC agreed to resolve a class action lawsuit alleging it failed to adequately protect personal and health information during a cyberattack in October 2023.

Who can file a claim?

Individuals must have received written notice directly from Carespring Health Care Management LLC stating the October 2023 data incident potentially impacted their private information.

How much can class members get?

Class members may claim the following benefits:

  • Reimbursement for documented out-of-pocket losses: Up to $4,500 per claimant. Class members must provide documentation showing the loss is fairly traceable to the data incident. Eligible expenses include:
    • Costs for credit reports
    • Credit monitoring costs incurred on or after Oct. 12, 2023
    • Long-distance phone charges
    • Cell phone/data usage charges
    • Internet usage charges
    • Text message charges
    • Miscellaneous expenses (notary, fax, postage, copying, mileage, etc.)
    • Unreimbursed bank fees, card reissuance fees, overdraft fees, late fees, overlimit fees and/or charges from banks or credit card companies
  • Alternative payment: Those who do not claim out-of-pocket may claim a $50 cash payment.
  • Credit monitoring: Two years of free credit monitoring, including $1,000,000 in identity fraud insurance

How to claim a class action payment

Class members can file a claim online or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is April 16, 2026.

What proof or documentation required to submit a claim?

  • To file an online claim, class members must log in with the unique ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@CarepsringDataSettlement.com and providing the class member's full name and mailing address.
  • To claim out-of-pocket losses, class members provide third-party documentation, such as receipts, bank statements or other records showing how the expenses relate to the data incident. Self-prepared documents alone are not sufficient but can supplement other proof.
  • To claim the $50 alternative payment or credit monitoring, class members must certify under penalty of perjury that they are eligible.

Settlement fund breakdown

The $305,000 settlement fund will cover:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: Up to $305,000
  • Service awards to class representatives: $2,500 each ($12,500 total)
  • Credit monitoring costs: Determined by number of valid claims
  • Payments to eligible class members: Remainder of the fund

When is the Carespring data breach settlement payout date?
