
If you purchased an Evenflo “Big Kid” booster seat in the United States, the District of Columbia, or any U.S. territory (including Puerto Rico, Guam, and the U.S. Virgin Islands) between January 1, 2008, and December 31, 2022, you may be eligible to submit a claim for a cash payment and a $25 credit per seat (up to two seats) from a class action settlement.
Evenflo Co., Inc. has agreed to pay $3.5 million to resolve a class action lawsuit that alleged the company misled consumers by marketing its “Big Kid” booster seats as “side impact tested” and safe for children weighing 30 pounds or more.
Who is eligible for an Evenflo booster seat payout?
You are a class member if:
- You purchased an Evenflo “Big Kid” booster seat in the United States, the District of Columbia, or any U.S. territory (including Puerto Rico, Guam, and the U.S. Virgin Islands).
- Your purchase occurred between January 1, 2008, and December 31, 2022.
- The seat purchased was one of the “Big Kid” belt-positioning booster seat models, which include both high-back and backless versions, and is one of the model numbers included in the settlement.
If you received a personalized notice with a Unique ID, you can use it to simplify your claim. If you did not receive a Unique ID, you will need to provide purchase details or documentation as described below.
How much is the class action settlement payment?
Class members who submit a valid claim can receive:
- Pro Rata Cash Payment: Class members can submit for a pro rata share of the Net Settlement Fund for each Evenflo “Big Kid” booster seat claimed, up to two seats. Payment amount will be determined by the number of valid claims filed.
- Evenflo Credit: Each approved claimant will also receive a $25 credit per seat claimed (up to two credits), valid for Evenflo products purchased directly from www.evenflo.com.
- Each credit is valid for one year from the date of Final Judgment.
- Only one credit can be used per transaction.
- Credits cannot be combined with other discounts or offers, and will not cover taxes or shipping.
- Credits can be transferred to another individual.
How to claim an Evenflo class action rebate
To claim a settlement payment, class members must submit a claim form by the deadline of November 24, 2025. You can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof and information
- Class members that received a settlement notice with a Unique ID do not need to submit supporting purchase information or proof.
- Class members that do not have a Unique ID must provide one of the following for each seat claimed:
- A purchase receipt, invoice, or credit card statement showing the purchase of a Big Kid booster seat.
- Documentation showing submission of the purchased seat to a retail rewards program.
- A photo of the seat or its packaging, along with the purchase city, state, and year.
- The retailer name, purchase city and state, purchase date, and color/pattern of the seat.

$3.5 million settlement fund
The $3,500,000 settlement fund will include the following:
- Settlement administration costs: To be determined
- Attorneys' fees and expenses: Amount to be presented to the court for approval at a later date
- Service awards to class representatives: Not to exceed $1,000 each
- Payments to approved claimants: Remaining settlement funds

When is the Evenflo Big Kid Booster Seat settlement payout date?
Payments will be issued to class members with valid claims approximately 60 days after the court grants final approval of the settlement and any appeals are resolved.
Why was there a class action lawsuit and settlement?
The class action lawsuit alleged that Evenflo misled consumers by marketing its “Big Kid” booster seats as “side impact tested” and safe for children weighing 30 pounds or more. Evenflo denies these allegations and any liability.
The parties involved agreed to settle to avoid the costs, and delays of further litigation and a possible trial. As part of the settlement, Evenflo has agreed to provide additional safety information, update its marketing to comply with federal regulations, and post an educational video about transitioning children to booster seats.
