Behavioral Health Resources agreed to settle a class action lawsuit alleging a November 2024 data incident allowed unauthorized access to files containing private information. Who can file a claim?
The settlement class includes individuals who meet the following criteria:
- They are U.S. residents
- The November 2024 Behavioral Health Resources data breach potentially compromised their data.
How much can class members get?
Class members can claim multiple benefits if they qualify, including:
- Out-of-pocket losses: Class members may claim up to $5,000 for documented, unreimbursed expenses related to the data incident. Class members must provide proof. Eligible losses must have occurred between Nov. 20, 2024, and Jan. 12, 2026, and may include:
- Losses from identity theft or fraud
- Fees for credit reports or credit monitoring
- Costs to freeze or unfreeze credit
- Costs to replace identification documents
- Postage or mailing costs to contact financial institutions
- Lost time reimbursement: Class members may claim up to five hours at $25 per hour (up to $125 total) for time spent responding to the incident. Class members must briefly describe the tasks performed, such as:
- Changing passwords
- Investigating suspicious activity
- Researching the data incident
- Addressing identity theft issues
- Pro rata cash payment: Class members may request a one-time cash payment currently estimated at $100. The final amount will depend on the number of valid claims. This benefit requires no proof.
- Medical data monitoring: Class members may elect to receive three years of CyEx Medical Shield Total. This option requires no documentation.
- This service includes:
- Monitoring for health insurance ID exposure, medical record number exposure and unauthorized health savings account spending
- Access to fraud resolution agents
- $1 million in medical identity theft insurance
How to claim a settlement payment
Class members must submit a claim form by the Jan. 12, 2026, deadline. They can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

What proof or documentation is required to submit a claim?
- For reimbursement of out-of-pocket expenses, class members must provide documents, such as receipts, invoices, bank statements or other records.
- For lost time reimbursement, class members must attest to the hours spent and briefly describe the tasks performed.
- For the pro rata cash payment, class members need only select the option on the claim form.
- For the medical data monitoring option, class members need only select the option on the claim form. This benefit does not require documentation.

The $1,100,000 settlement fund will include:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $366,666.67
- Attorneys' expenses: Up to $25,000
- Service awards to class representatives: $2,500 each ($12,500 total)
- Medical data monitoring: Cost determined by the number of approved claims
- Payments to eligible class members: Determined by number of valid claims

When is the Behavioral Health Resources data breach settlement payout date?
The settlement administrator will issue payments within 30 days after the court resolves any appeals and grants final approval of the settlement.
