Individuals who received a notice from Wescom Central Credit Union about a security incident in October 2023, may qualify to submit a claim for up to $2,060, plus one year of credit monitoring, from a class action settlement.

Wescom Credit Union and Barracuda Networks Inc. have agreed to pay to settle a class action lawsuit regarding alleged failures in protecting private information following a data breach involving Wescom current and former customers. The cybersecurity incident affected approximately 32,964 individuals.

Who can file a data breach claim?

Class members must meet the following criteria:

  • They received a notice of data breach letter from Wescom Central Credit Union regarding a security incident discovered on or around May 30, 2023.
  • The notice was sent on or about Oct. 20, 2023, and involved unauthorized access to an email secure gateway provided by Barracuda Networks Inc.

How much is the class action settlement payment?

Class members can submit to receive one or more of the following options:

  • Documented ordinary losses: Class members can claim up to $500 per person for out-of-pocket monetary losses directly resulting from the data breach. Eligible expenses include: unreimbursed bank or credit card fees, data charges, fees for credit reports, freezing/unfreezing, credit monitoring or insurance products purchased between Oct. 2022 and Jan. 27, 2026.
  • Lost time: Class members can claim up to three hours of lost time at $20 per hour for time spent dealing with the incident, a maximum of $60.
  • Documented extraordinary losses: Class members can claim up to $1,500 for actual, documented, unreimbursed extraordinary losses that were more likely than not caused by the data breach. Losses must not be covered by other categories and must have occurred between Oct. 2022 and Jan. 27, 2026.. Claimants must show they made reasonable efforts to avoid or seek reimbursement for the loss.
  • Credit monitoring: Class members are eligible to receive a one-year membership of 3B credit monitoring with at least $1 million in fraud protection through CyEx. Class members do not need to submit a claim to receive this benefit. Enrollment codes were included in the official settlement notice and will be active after the settlement is granted final approval.

How to claim a class action rebate

To receive a settlement payment, class members must file a claim by Jan. 27, 2026. Class members can submit the online claim form or download and print the PDF claim form to mail or email to the settlement administrator.

Class members do not need to submit a claim to receive the credit monitoring benefits. Enrollment codes were included in the settlement notice.

  • Documented ordinary losses and extraordinary losses claims require supporting documentation, which may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges or other third-party proof.

Data breach settlement fund breakdown

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Up to $125,000
  • Service award to the named plaintiff: Not to exceed $5,000
  • Credit monitoring services: Cost determined by number of class member enrollments
  • Payments to approved claimants: Total determined by the number of claims filed

When is the Wescom Central Credit Union data breach payout date?

Payments to eligible class members will be issued 75 days after the settlement is granted approval, or when the claim is approved, whichever is later.

Why was there a class action settlement?

This class action lawsuit was filed after a security incident in October 2022, when an unauthorized third party accessed an email secure gateway provided by Barracuda Networks to Wescom Central Credit Union. The lawsuit alleged that private information of current and former credit union members was potentially exposed.

Both Wescom and Barracuda Networks deny the allegations, but agreed to settle to avoid the risk and expense of continued litigation and a possible trial.
