
Patients who had a MyAtriumHealth or MyCarolinas patient portal account at any time between Jan. 1, 2015, and April 10, 2024, may be eligible to claim a cash payment from a class action settlement.
The Charlotte-Mecklenburg Hospital Authority, d/b/a Atrium Health, agreed to pay $1.8 million to settle a class action lawsuit. The lawsuit alleges Atrium Health used pixel technology on its website and, for a limited period, within its patient portal, that disclosed personal and health-related information to third parties, including Meta and Google.
Who can file a claim?
The settlement class includes all individuals residing in the United States who had a MyAtriumHealth or MyCarolinas patient portal account at any time between Jan. 1, 2015, and April 10, 2024.
Within this group, there are two categories of class members with different payment structures:
- Those who accessed or used their patient portal account between Jan. 1, 2015, and July 31, 2019 (referred to as Group 1)
- Those who had a patient portal account between Jan. 1, 2015, and April 10, 2024, but did not access it during the earlier period (referred to as Group 2)
Class members can only qualify for one group based on their usage history.
How much can class members get?
The amount each class member can receive depends on which group they fall into and the total number of valid claims submitted.
- Group 1 (accessed portal between Jan. 1, 2015, and July 31, 2019): Eligible for a pro rata share of the net settlement fund after deductions for attorneys’ fees and costs, service awards to class representatives and administration costs.
- Group 2 (had an account but did not access it during the Group 1 period): Eligible for a payment of up to $10. There is a $300,000 total cap for this group. If the number of valid claims exceeds the cap, the settlement administrator will reduce payments on a pro rata basis.
How to claim a settlement payment
Class members can file a claim online or download and print the PDF claim form, complete it and mail it to the settlement administrator.

- Payments to Group 1 class members: Remaining balance
- Payments to Group 2 class members: Up to $300,000 total

When is the Atrium Health pixel settlement payout date?
The settlement administrator will distribute payments to eligible class members as soon as possible after the court resolve any appeals and grants final approval of the settlement.

Atrium Health denies any wrongdoing or legal violations but agreed to settle to avoid the costs and risks of continued litigation.
