
Individuals who resided in Florida between July 1, 2021, and Aug. 20, 2024, and received a text message from Athena Bitcoin after sending a “stop” request may be eligible to submit a claim for a cash payment from a class action settlement.
Athena Bitcoin Inc. agreed to pay $4.5 million to settle a class action lawsuit alleging it sent telemarketing text messages to individuals who requested them to stop in violation of federal and Florida state law.
Two settlement classes, IDNC and FTSA, share the $4.5 million settlement fund. IDNC class members can file a claim here.
Who can file a TCPA claim?
FTSA class members must meet the following criteria:
- They resided in Florida at any time between July 1, 2021, and Aug. 20, 2024.
- They had a telephone number with a Florida area code.
- They sent a text message containing only the word “stop” to Athena Bitcoin anytime between July 1, 2021, and Aug. 20, 2024.
- They received at least one text message from Athena Bitcoin promoting goods or services more than 15 days after sending the “stop” message.
How much will settlement payments be?
Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment from the net settlement fund. The settlement administrator will determine the final payment amount by the number of text messages received the class member received after sending "stop" and the total number of claims submitted by both FTSA and IDNC class members.
How to claim a class action rebate
To receive a settlement payment, FTSA class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required claim information
- All class members must provide the phone number(s) that received Athena text messages on their claim form.
- They must also attest they resided in Florida between July 1, 2021 and Aug. 20, 2024.
- To submit an online claim, class members must provide the class member ID from the settlement notice they received.

The $4,500,000 settlement funds for both IDNC and FTSA class members will include:
- Settlement administration costs: To be determined
- Attorneys’ fees: Up to $1,485,000
- Attorneys’ expenses: To be presented to the court for approval at a later date
- Service award to class representative: Up to $9,000
- Payments to approved IDNC and FTSA claimants: Remaining settlement funds

When is the Athena Bitcoin Florida TCPA settlement payout date?
The settlement administrator will issue payments to all approved FTSA and IDNC claimants after it completes claim processing and the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Athena Bitcoin sent telemarketing text messages to Florida residents after they requested the messages stop in violation of the Florida Telephone Solicitation Act.
Both parties agreed to settle to avoid the risk and expense associated with further litigation.
