
U.S. residents whose private information the Akumin Operating Corp. data incident may have compromised on Oct. 11, 2023, and who received notice of the incident may qualify to claim up to $2,500 and/or one year of free medical data monitoring from a class action settlement.
Akumin Operating Corp. agreed to resolve a class action lawsuit alleging it failed to adequately protect private information, resulting in an October 2023 breach.
Who can file a claim?
Class members must meet all of the following criteria:
- They are a living individual who resides in the United States.
- The Akumin data incident that occurred on Oct. 11, 2023, potentially impacted their private information.
- They received notice of the data incident from Akumin Operating Corp.
The impacted data may include:
- Names
- Home addresses
- Email addresses
- Other contact information
- Dates of birth
- Social Security numbers
- Driver’s license or passport numbers
- Medical record numbers, Medicare or Medicaid IDs or other patient/unique identifiers
- Financial accounts or payment card information
- Diagnosis, treatment or patient imaging data
- Occupational health or biometric information
- Medical history, billing or claims information
- Health insurance subscriber/group policy numbers or benefits information
- Electronic signatures
How much can class members get?
Eligible class members may claim one or both of the following benefits:
- Up to $2,500 in cash reimbursement for documented losses related to the data incident. Examples of eligible expenses include:
- Unreimbursed losses from fraud or identity theft
- Costs to freeze or unfreeze credit with any credit reporting agency
- Miscellaneous expenses, such as notary, postage, copying or mileage
- Credit monitoring or identity theft protection purchased as a result of the incident
- Professional fees paid to address identity theft or fraud
- One year of free medical data monitoring (CyEx Medical Shield Complete, which includes one-bureau monitoring, at least $1,000,000 of identity theft insurance and real-time alerts)
How to claim a settlement benefit
Class members can complete the online claim form or download, print, and complete the PDF claim form then mail it to the settlement administrator. The claim deadline is Nov. 30, 2025.

What proof or documentation is necessary to submit a claim?
Claimants must provide detailed documentation for any cash payment claim. Acceptable proof includes:
- Receipts for expenses, such as credit freeze fees or credit monitoring
- Account statements with unauthorized charges
- Police reports
- Internal Revenue Service or Federal Trade Commission identity theft reports
- Letters from banks or insurers refusing to refund fraudulent charges
- Bills or invoices from professionals (e.g., accountants, lawyers)
Personal certifications or affidavits alone are not sufficient but may supplement other documentation.
Claimants do not need to provide proof for the medical data monitoring benefit.
Payout options
- Eligible class members who claim a cash payment will receive an email prompting them to select either an electronic payment or paper check.
- Eligible class members who claim medical data monitoring will receive an email containing an activation code and instructions for redemption.
Settlement fund breakdown
The $2,850,000 settlement fund covers:
- Settlement administration costs: Up to $250,000
- Attorneys’ fees: Up to $2,850,000
- Service awards to class representatives: Up to $2,500 each
- Medical data monitoring costs: Determined by number of claims
- Payments to class members: Up to $1,500,000 (should claims exceed this amount, the settlement administrator will pro rate payments)

When is the Akumin data incident payout date?
The settlement administrator will distribute payments and benefits to eligible claimants approximately 105 days after the court grants final approval and the settlement becomes final.
Why did this class action settlement happen?
The class action lawsuit alleged Akumin Operating Corp. experienced a data incident on Oct. 11, 2023, that resulted in unauthorized access to or acquisition of private information. The plaintiffs claimed Akumin failed to adequately protect this information.
Akumin denies any wrongdoing. Both sides agreed to settle to avoid the risks, costs and delays of further litigation.
