Employees who scanned their finger at a job location in Illinois between Aug. 29, 2016, and Sept. 15, 2025, may be eligible to claim an estimated $100 to $500 from a class action settlement.

Accu-Time Systems Inc. agreed to pay $1.5 million to settle a class action lawsuit alleging violations of Illinois’ Biometric Information Privacy Act. The lawsuit claimed Accu-Time Systems Inc. collected biometric data from individuals using finger-scanning time clocks at certain companies in Illinois without providing the required notice or obtaining written consent.

Who can file a claim?

Class members must meet all of the following criteria:

  • They scanned their finger on an Accu-Time biometric time clock device in Illinois.
  • They scanned their finger between Aug. 29, 2016, and Sept. 15, 2025.
  • They scanned their finger while working for one of the following companies:

Individuals who received a notice about the settlement by mail or email are most likely class members.

How much can class members get?

Eligible class members who submit a valid claim form will receive an equal share of the fund estimated at $100 to $500 per person. The actual payment amount depends on the number of valid claims submitted and deductions for attorneys' fees, service awards for class representatives and settlement administration costs.

How to claim a class action payment

Class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is March 12, 2026.

Required claim information

  • To file an online claim, class members must log in using the claim number and PIN from the postcard notice and claim form they received.
  • Class members may need to complete an IRS Form W-9 for tax reporting purposes. They can complete it now on the settlement website to ensure prompt payment if their claim receives approval.

$1.5 million settlement fund breakdown

When is the Franchini v. Accu-Time Systems Inc. payout date?

The settlement administrator will distribute payments approximately 29 days after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The class lawsuit alleged that Accu-Time Systems Inc. violated Illinois’ Biometric Information Privacy Act by collecting and storing biometric data from individuals using finger-scanning time clocks in Illinois without providing the required notice or obtaining written consent.
