Consumers who lived in the United States and had their personally identifying information exposed to unauthorized third parties in a July 2024 data breach involving WorkWave LLC doing business as Team Software may qualify to claim up to $5,000 plus additional benefits from a class action settlement.

WorkWave LLC agreed to pay $1.5 million to settle a class action lawsuit alleging negligence and breach of third-party beneficiary contract related to a data security incident that potentially exposed sensitive personal information to cybercriminals.

Who can file a WorkWave claim?

Class members must meet all of the following criteria:

  • They resided in the United States at the time of the data breach.
  • Their personally identifying information, such as name, Social Security number and/or driver’s license number, was exposed to unauthorized third parties as a result of the WorkWave data security incident that occurred in or around July 2024.
  • They received a breach notification letter from WorkWave regarding the incident.

How much can class members get?

  • Reimbursement of documented monetary losses: Up to $5,000 per person for documented monetary losses traceable to the data breach. Eligible losses include:
    • Unreimbursed losses relating to fraud or identity theft
    • Professional fees, such as attorneys’ fees, accountants’ fees and credit repair service fees
    • Costs associated with freezing or unfreezing credit with any credit reporting agency
    • Credit monitoring costs incurred on or after the data breach through the date of claim submission
    • Miscellaneous expenses, such as notary, postage, copying and mileage
  • Identity theft protection and credit monitoring: All class members may claim two years of single-bureau identity theft protection and credit monitoring, which includes at least $1,000,000 in fraud and identity theft insurance.
  • Pro rata cash payment: After the settlement administrator pays attorneys’ fees, expenses, service awards, administration and notice costs, identity theft protection costs and valid monetary loss claims, it will distribute the remaining settlement fund equally among all claimants who submit valid claims. There is no maximum payment amount for this benefit, and the actual amount will depend on the number of valid claims and the total funds left after other payments.

How to claim a class action payment

Class members can file a claim online using the online claim form or download, print and complete a PDF claim form and mail or email it to the settlement administrator.

What proof or documentation is required to submit a claim?

  • All class members must provide the notice ID number from the notification letter they received.
  • For reimbursement of documented monetary losses, claimants must provide supporting documentation for each claimed loss. Acceptable documentation includes receipts, invoices or other non-self-prepared documents that show the costs. Handwritten receipts alone are not sufficient but may be submitted as supplemental information.
  • For identity theft protection and pro rata cash payment claims, claimants must attest to their eligibility as class members and select the appropriate option.

Claimants who select a digital payment option will receive a verification email and must authenticate their payment information. If they do not, they will receive a paper check instead.

The settlement administrator will send activation codes for identity theft protection to class members if the settlement is approved. Class members can use the code to enroll in the protection for up to 12 months after distribution, and coverage will last two years from activation.

$1.5 million settlement fund breakdown

The $1,500,000 settlement fund covers:

  • Settlement administration costs: $300,000
  • Attorneys' fees: Up to $500,000
  • Attorneys' expenses: Up to $25,000
  • Service awards to class representatives: $2,500 each
  • Identity theft protection costs: To be determined
  • Payments to eligible class members: The remainder of the fund

When is the WorkWave data breach settlement payout date?

The settlement administrator will make payments after the court grants final approval of the settlement and resolves any appeals.

Why did this class action settlement happen?

The class lawsuit alleged WorkWave experienced a data security incident in July 2024 in which cybercriminals accessed files containing personal information. The plaintiffs alleged negligence and breach of third-party beneficiary contract.

WorkWave denies wrongdoing but agreed to settle to avoid the risks and costs of litigation. The settlement provides compensation and enhanced data security measures for affected individuals.
