Current and former customers who received a notice from Union Bank and Trust that the 2023 MOVEit data breach potentially compromised their personally identifiable information may be eligible to submit a claim for up to $12,500 and credit monitoring services from a class action settlement.

Union Bank and Trust Co. agreed to pay $2.39 million to settle a class action lawsuit alleging its negligent data security practices led to a data breach involving the MOVEit Transfer software between May 27 and May 31, 2023. The cybersecurity incident impacted personal information belonging to approximately 207,824 individuals.

Who can file a claim for a MOVEit data breach payout?

Class members are individuals in the United States whose personally identifiable information the Union Bank and Trust MOVEit data breach compromised.

How much will settlement payments be?

Class members have the following benefit options:

  • Ordinary losses: Class members can claim up to $2,500 in ordinary losses traceable to the data breach. This includes bank fees, postage for contacting financial institutions and fees for credit monitoring purchased after May 31, 2023. Class members can also claim up to four hours of lost time spent dealing with the breach at $25 per hour for a maximum of $100.
  • Extraordinary losses: Class members can claim up to $10,000 in documented and unreimbursed monetary losses related to the data breach that occurred between May 31, 2023, and July 21, 2026. This includes professional fees and losses due to fraud and identity theft.
  • Alternative cash payment: Class members who do not submit an ordinary or extraordinary losses claim can submit a claim to receive a $100 pro rata cash payment. The settlement administrator will determine the final payment amount by the total number of claims filed.
  • Credit monitoring and identity theft protection: All class members can elect to receive two years of three-bureau credit monitoring and identity theft protection, which includes dark web monitoring, identity theft insurance up to $1 million, real-time credit monitoring and access to fraud resolution and identity theft restoration agents.

How to claim a class action rebate

To claim a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof and claim information

  • All claims require the claimant ID from the settlement notice the class member received. Online claimants must also provide the password from the same notice.
  • Ordinary and extraordinary losses claims require supporting documentation, which may include receipts, invoices for services, bank or credit card statements showing unreimbursed fees or fraudulent charges, police reports and any other proof of fraud or identity theft.
