Individuals who received a direct mail notice at a California address from Trinity Health Corp. about a data security incident that occurred on or about Jan. 20, 2021, may qualify to claim up to $1,000 for out-of-pocket losses and a pro rata cash payment from a class action settlement.

Trinity Health Corp. agreed to pay $450,000 to settle a class action lawsuit alleging it failed to protect patient data, resulting in a breach involving the Accellion File Transfer Appliance. The compromised data may include:

  • Names
  • Addresses
  • Emails
  • Dates of birth
  • Health care providers
  • Dates and types of health care services
  • Medical record numbers
  • Immunization types
  • Lab results
  • Medications
  • Payments, payer names and claims information
  • Social Security numbers
  • Credit card information

Who are the class members?

Class members must meet all of the following criteria:

  • They received a direct mail notice from Trinity Health Corp. about the data security incident that occurred on or about Jan. 20, 2021.
  • The settlement administrator addressed the notice to a California address.
  • The incident may have impacted their data.

The settlement affects approximately 18,153 California residents.

How much can class members get?

Class members who submit a valid and timely claim form can receive a pro rata cash payment and may also claim reimbursement for documented out-of-pocket losses.

The pro rata cash payment is estimated to be:

  • $231 if 5% of class members submit claims
  • $115 if 10% of class members submit claims
  • $11 if 100% of class members submit claims

Class members may also claim up to $1,000 for documented, out-of-pocket losses or expenditures fairly traceable to the data security incident. These may include:

  • Losses from documented identity theft or fraud
  • Card cancellation or replacement fees
  • Credit-related costs, such as for credit reports, credit monitoring or identity theft protection
  • Costs to place a freeze or alert on credit reports
  • Costs to replace a driver’s license, state identification card or Social Security number
  • Late, declined payment, overdraft, returned check or customer service fees attributable to documented identity theft or fraud

If the total amount class members claim for out-of-pocket losses exceeds the available settlement funds, the settlement administrator may reduce payments on a pro rata basis.

If any money remains in the net settlement fund more than 120 days after the settlement administrator distributes payments, it may make a subsequent payment to all class members who cashed or deposited their initial pro rata cash payment provided the average payment amount is equal to or greater than $10. Following this second distribution, the settlement administrator will distribute any amount remaining in the net settlement to the nonprofit residual recipient.

How to claim a class action payment

Class members can file a claim online or download, print and complete the PDF claim form (Page 62 of the settlement agreement) and mail it to the settlement administrator. The claim deadline is Jan. 19, 2026.

What proof or documentation is required to submit a claim?

  • To receive reimbursement for documented, out-of-pocket losses, class members must submit supporting documentation, such as receipts, account statements, police reports or other evidence showing the loss resulted from the data security incident.
  • To receive a pro rata cash payment, class members need only select the appropriate option.
  • To file an online claim, class members must provide the class member ID from their settlement notice.

When is the Trinity Health Corp. settlement payout date?

The class action lawsuit alleged Trinity Health Corp. failed to adequately safeguard patient data, resulting in a data breach when an unauthorized party accessed files on the Accellion File Transfer Appliance in January 2021. The files contained sensitive personal and health information.
