Individuals who received a notice stating the Triage Staffing data breach that occurred in May 2025 may have compromised their personal information could qualify to submit a claim for up to $3,000 plus credit monitoring from a class action settlement.

Triage LLC, d/b/a Triage Staffing, agreed to pay to settle a class action lawsuit alleging a data incident potentially exposed files containing sensitive information, such as names, addresses, dates of birth and Social Security numbers.

Who can file a claim for a data breach payout?

Class members are individuals residing in the United States whose personal information the Triage Staffing data incident that occurred on or around May 2025 potentially compromised and whom the company sent a notice letter about the breach.

How much are settlement payments?

Class members have the following benefit options:

  • Ordinary losses: Class members can claim up to $500 for documented out-of-pocket expenses related to the data breach. Eligible expenses must have occurred between May 2025 and Aug. 10, 2026, and may include fees for credit reports, credit monitoring, freezing or unfreezing credit, costs to replace IDs and postage to contact financial institutions.
  • Extraordinary losses: Class members who experienced identity theft or fraud the data breach most likely caused can claim up to $2,500 for documented losses. Eligible losses must have occurred between May 2025 and Aug. 10, 2026., and must not already be covered by ordinary losses. The claimant must show they tried to prevent the loss or recover funds, such as by using insurance.
  • Alternative cash payment: Class members who do not claim ordinary or extraordinary losses can submit a claim to receive a one-time $50 cash payment.
  • Credit monitoring services: All class members may elect to receive two years of CyEx Identity Defense Total, which includes $1 million in identity theft insurance, real-time credit monitoring, dark web scanning, comprehensive public records monitoring and access to fraud resolution agents.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail or email to the settlement administrator.

Required proof and claim information

  • Ordinary losses require supporting documentation, which may include receipts, invoices or other proof of out-of-pocket expenses.
  • Extraordinary losses claims require supporting documentation, which may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges, police reports and other proof of identity theft or fraud the data breach caused.

When is the Triage Staffing data breach settlement payout date?

Why did this class action settlement happen?

This class action lawsuit alleged a cybercriminal infiltrated Triage Staffing's computer systems in May 2025 and potentially accessed certain files containing personal information without authorization. The plaintiffs claimed Triage failed to adequately protect this information, leading to the risk of identity theft and fraud.

Triage Staffing denies the allegations but agreed to settle to avoid the expense and uncertainty of continued litigation.
