Consumers who purchased one or more Tom’s of Maine toothpaste products in the United States between Nov. 21, 2020, and March 6, 2026, may be eligible to submit a claim for up to three product cash refunds from a class action settlement.

Colgate-Palmolive Co. and its subsidiary Tom’s of Maine Inc. have agreed to pay $2.9 million to settle multiple class action lawsuits. The plaintiffs claimed that the companies engaged in deceptive and misleading business practices related to the manufacturing, marketing, and sale of certain Tom’s toothpaste products manufactured at Tom’s facility in Sanford, Maine. The settlement resolves six class action lawsuits.

Who can file a claim for a Tom's of Maine payout?

Class members must meet the following criteria:

  • They purchased one or more Tom’s of Maine toothpaste products in the United States between Nov. 21, 2020, and March 6, 2026.
  • The products were purchased for personal use, not for resale or distribution.

How much are settlement payments?

Class members have the following cash payment options:

  • Without proof of purchase: Class members with no proof of purchase can submit to receive the average manufacturer’s suggested retail price (MSRP) for one Tom’s of Maine toothpaste product per household. Payment amount will be based on the average MSRP during the class period.
  • With proof of purchase: Class members with proof of purchase can submit to receive a full refund of the amount spent on Tom’s toothpaste, for up to three products per household.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Claims must be submitted online or postmarked by July 6, 2026. Only one claim per household is allowed.

When is the Tom's of Maine toothpaste settlement payout date?

Payments will be issued to approved claimants approximately 60 days after the court grants final approval of the settlement.

Why was there a class action settlement?

The class action lawsuits alleged that Colgate-Palmolive Co. and Tom’s of Maine Inc. engaged in deceptive and misleading business practices in the manufacturing, marketing, and sale of Tom’s toothpaste products. In May 2024, the FDA identified concerns about conditions at Tom’s manufacturing facility in Sanford, Maine, noting non-compliance with certain manufacturing processes. However, a review of finished products found no safety risk to consumers.

The companies deny the allegations but agreed to settle to avoid the expense and risk of continued litigation and a possible trial.
