Current or former patients of The Christ Hospital who used its patient portal or mobile app or submitted a health risk assessment, appointment request form or nurse navigator request form between Dec. 30, 2018, and Jan. 13, 2023, may qualify to claim a cash payment and one-year subscription to Privacy Shield Pro from a class action settlement.

The Christ Hospital agreed to pay up to $7 million to resolve a class action lawsuit alleging it improperly disclosed protected health information to third parties, such as Facebook and Google, through tracking tools on its digital platforms.

Who are the class members?

Class members must meet the following criteria:

  • They are or were a patient of The Christ Hospital or any of its affiliates.
  • They used The Christ Hospital’s patient portal and/or mobile app.
  • They submitted a health risk assessment, appointment request form or nurse navigator request form on The Christ Hospital’s website.
  • Their use or submission occurred between Dec. 30, 2018, and Jan. 13, 2023.

The Christ Hospital provided a list of individuals who meet these criteria to the settlement administrator, which sent notices to those identified.

How much can class members get?

Eligible class members who submit a valid claim can receive:

  • A cash payment estimated at $37.50
  • A one-year subscription to Privacy Shield Pro, a product that monitors for medical identity theft and fraud

The settlement fund is structured as follows:

  • The Christ Hospital will fund at least $4.5 million for the settlement. This amount is non-reversionary, meaning it will not revert to the hospital if not fully used.
  • If, after all deductions, the remaining fund is insufficient to pay each valid claim at least $37.50, The Christ Hospital will contribute up to an additional $2.5 million to ensure each valid claim receives $37.50 for a maximum total settlement fund of $7 million.
  • If the number of valid claims is so high that $7 million is insufficient to pay $37.50 per claim, each valid claim will be paid a reduced (pro rata) amount.

The lawsuit alleged The Christ Hospital installed tracking tools on its digital platforms, resulting in the unauthorized disclosure of protected health information to third parties, such as Facebook and Google.

The hospital denies these allegations and any wrongdoing. Both sides agreed to settle to avoid the uncertainties and expenses of continued litigation and to provide benefits to class members.
