
Consumers who received a prerecorded call from Truist Bank about an account that was not theirs between Feb. 10, 2019, and Aug. 31, 2022, may qualify an approximately $440 payment from a class action settlement.
Truist Bank agreed to pay $4,100,000 to settle a class action lawsuit alleging it made prerecorded calls to cell phones about accounts unrelated to the recipients in violation of the Telephone Consumer Protection Act.
Who is eligible for a Truist Bank payment?
Class members must meet the following criteria:
- They were the subscriber or regular user of one of 5,998 specific telephone numbers.
- The phone number was assigned to cellular telephone service in the United States.
- They received a prerecorded telephone call from Truist Bank.
- The call concerned an account unrelated to them.
- The call occurred between Feb. 10, 2019, and Aug. 31, 2022.
The list of class members was compiled using call records obtained during litigation. Class members who received a notice by mail or email most likely qualify.
How much is the TCPA payment?
Each class member is estimated to receive a cash payment of approximately $440. This estimate is based on the total settlement fund minus deductions for attorneys' fees, costs, service awards and administration expenses divided equally among all class members who do not opt out.
If there are uncashed checks after the first payment distribution, a second distribution will be made to those who cashed their initial checks provided the amount is at least $10 per person. Any remaining funds after the second distribution will be given to either the National Consumer Law Center or Legal Aid of North Carolina, pending court approval.
No claim form necessary
Class members do not need to file a claim to receive their payment. If they received a notice by mail, they will receive a check to the same address. Those who need to update their address can do so by emailing the settlement administrator at the address below.
