
California residents who logged into a Sutter Health MyHealthOnline portal account between June 10, 2015, and March 20, 2020, for their own health care purposes may be eligible to submit a claim for up to $90 from a class action settlement. The class includes approximately 1,628,160 individuals.
Sutter Health agreed to pay $21.5 million to settle a class action lawsuit alleging it disclosed patients’ personally identifiable information and/or protected health information to third parties, including Google and Meta, without consent. The lawsuit claimed that Sutter Health’s use of third-party tracking technologies on certain webpages, including the MyHealthOnline portal login page, violated California state law.
Who is eligible for a Sutter Health settlement payout?
Class members must meet the following criteria:
- They logged into their own Sutter Health MyHealthOnline portal account between June 10, 2015, and March 20, 2020.
- The log-in was for their own personal health care purposes.
- They were a California resident at the time of log-in.
How much is the class action settlement payment?
Pro rata cash payment: Class members can submit a claim to receive a cash payment of up to $90. The settlement administrator will determine the final payment amount by the total number of valid claims filed.
How to claim a class action rebate
To receive a settlement payment, individuals must submit a valid claim form by April 28, 2026. They can submit their claim one of two ways:
- Complete the online claim form
- Print the PDF claim form and mail it to the settlement administrator

The $21,500,000 settlement fund includes:
- Settlement administration costs: Estimated between $385,000 and $445,000
- Attorneys' fees: Up to $7,095,000
- Attorneys' expenses: Estimated to be $208,990.21
- Service awards to class representatives: Up to $10,000 each
- Payments to approved claimants: Remaining settlement funds

When is the Sutter Health privacy settlement payout date?
The settlement administrator will issue payments to class members with valid claims approximately 150 days after the court grants final approval of the settlement.
Why is there a class action settlement?
This class action lawsuit alleged Sutter Health violated the California Invasion of Privacy Act and breached contractual obligations by disclosing patients’ PII and/or PHI to third parties, such as Facebook and Google, through its use of third-party tracking, analytics and advertising technologies on certain web pages, including the MyHealthOnline portal log-in page.
Sutter Health denies any wrongdoing. Both parties agreed to settle to avoid the risk and expense of further litigation.
