Consumers who received a notice from Restek Corp. regarding a data security incident that may have compromised their personal information could be eligible to claim up to $3,925 plus credit monitoring from a class action settlement.

Restek Corp. agreed to resolve a class action lawsuit alleging it failed to adequately protect the personal information of certain current and former employees during a data breach in June 2023.

The types of personal information that may have been affected include:

  • Names or initials and last names
  • Social Security numbers
  • Dates of birth
  • Driver’s license numbers
  • Employer-assigned identification numbers
  • Passport numbers
  • Financial information
  • System access information
  • Medical information
  • Health insurance information

Who are the class members?

Class members must meet the following criteria:

  • They reside in the United States.
  • Restek Corp. identified their personal information as potentially compromised in the data security incident that began on or about June 2, 2023.
  • They received a notice from Restek Corp. about the data security incident.

How much can class members get?

Class members can claim several types of benefits, depending on their circumstances and the losses they experienced:

  • Ordinary losses: Up to $425 per person for documented, unreimbursed out-of-pocket expenses related to the data breach. Eligible expenses include:
    • Attorneys’ or accountants’ fees
    • Fees for credit repair services
    • Costs to freeze or unfreeze credit
    • Postage or gasoline for local travel
    • Fees for credit reports, credit monitoring or identity theft insurance products purchased between Dec. 5, 2023, and Jan. 9, 2026
  • Lost time: Up to four hours of lost time at $20 per hour (maximum $80). Lost time reimbursement counts toward the $425 cap for ordinary losses.
  • Extraordinary losses: Up to $3,500 per person for documented, unreimbursed monetary losses resulting from actual identity theft or fraud the data breach most likely caused.
  • Alternative cash payment: A $50 payment in lieu of claims for ordinary losses, lost time and extraordinary losses. Class members cannot combine this with other monetary claims.
  • Credit monitoring: All class members who submit a valid claim can receive two years of free credit monitoring and identity theft protection through IDX, which includes single-bureau credit monitoring, dark web monitoring, $1 million in reimbursement insurance and identity recovery assistance.

All monetary claims (ordinary losses, lost time, extraordinary losses and alternative cash payments) are subject to a combined cap of $210,000 for all class members. If the total value of valid claims exceeds this cap, the settlement administrator will reduce payments proportionally.

How to claim an settlement payment

Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Jan. 9, 2026.

Required proof and documentation

  • To file any claim, class members must provide the notice ID number and PIN from their postcard notice.
  • To file an ordinary losses claim, class members must provide third-party documentation, such as receipts, bills or statements, showing the out-of-pocket expenses.
  • To file a lost-time claim, class members must must provide a written description of the time spent addressing the data breach and attest under penalty of perjury that the time was related to the incident.
  • To file an extraordinary losses claim, class members must provide documentation of the monetary loss, proof that the loss was not reimbursed elsewhere and evidence that the data breach most likely caused the identity theft or fraud.
  • To claim the alternative cash payment, class members do not need to provide documentation.

Settlement fund breakdown

The settlement fund covers:

  • Settlement administration fees: To be determined
  • Attorneys’ fees, costs and expenses: Up to $130,000
  • Service award to class representative: Up to $2,500
  • Credit monitoring costs: Determined by number of valid claims
  • Payments to eligible class members: Up to $210,000

When is the Restek data security settlement payout date?

The settlement administrator will issue payments after the court resolves appeals and grants final approval to the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Restek Corp. experienced a data security incident in June 2023 involving unauthorized access to company systems and files, including employees' sensitive personal information. The plaintiffs claimed Restek Corp. failed to adequately protect this information.

Restek Corp. denies any wrongdoing but agreed to settle to avoid the cost and uncertainty of further litigation.
