Individuals who used the Flo App in the United States between Nov. 1, 2016, and Feb. 28, 2019, may qualify to submit a claim for a payment from a class action settlement, which is pending preliminary approval.
Flo Health Inc. has agreed to pay $8 million, Google LLC has agreed to pay $48 million, and Flurry LLC has agreed to pay $3.5 million to resolve a lawsuit alleging that users’ menstruation and pregnancy information was improperly shared with third parties, including Google, Flurry, and Meta, through the Flo app. The combined settlement fund totals $59.5 million.
A motion for preliminary approval of the class action settlement was filed in federal court on Sept. 23, 2025. Meta remains the only non-settling defendant.
Who is eligible for a Flo app privacy settlement payout?
All class members must mee the following criteria:
- They used the Flo App in the United States at any time from Nov. 1, 2016, to Feb. 28, 2019.
- They entered menstruation and/or pregnancy information into the Flo App during the qualifying period.
There are two groups of eligible class members:
- Nationwide class: All individuals in the United States who used the Flo App and entered menstruation and/or pregnancy information during the class period.
- California subclass: Individuals who used the Flo App in California, entered menstruation and/or pregnancy information during the class period, and resided in California during the class period.
How much is the class action payment?
- Pro rata cash payment: Each approved nationwide class member will receive a pro rata cash payment from the net settlement fund. Final payment amount will be determined by the number of claims filed.
- California subclass members will receive a pro rata cash payment that is twice the amount of the nationwide class member pro rata payment.
How are payments calculated?
Payments will be issued on a pro rata basis, meaning each eligible claimant will receive a share of the net settlement fund. California subclass members receive two shares.
Payment Example: If the net settlement fund is $40 million and there are 100,000 valid claims (10,000 from California Subclass members and 90,000 from other class members)
- California Subclass members: 10,000 x 2 = 20,000 shares
- Other class members: 90,000 x 1 = 90,000 shares
- Total shares: 110,000
- Each share: $40,000,000 ÷ 110,000 = $363.64
- Each California subclass member: 2 x $363.64 = $727.27
- Each nationwide class member: $363.64

Why is there a proposed class action settlement?
The class action lawsuit alleged that Flo Health, Google, Flurry and Meta improperly shared sensitive user information from the Flo App with third parties without user consent. Plaintiffs claimed this conduct violated federal and California privacy and consumer protection laws, including the California Confidentiality of Medical Information Act and the California Invasion of Privacy Act.
The settling defendants, Flo Health, Google and Flurry, deny any wrongdoing, but agreed to settle to avoid the risk and expense of continued litigation and a trial. Meta remains a non-settling defendant.
