Consumers who received a notice from Progressive Leasing that a data breach around Sept. 11, 2023, may have compromised their private information could be eligible to submit a claim for up to $5,000 plus a California resident payment and credit monitoring from a class action settlement. The cybersecurity incident affected an estimated 216,000 Progressive Leasing current and former customers.
Prog Leasing LLC agreed to pay $3.25 million to settle a class action lawsuit alleging a third party gained unauthorized access to certain Progressive Leasing systems, potentially exposing the personal information of customers. The plaintiffs claimed this resulted from negligent data security practices and violations of California statutory law.
Who is eligible for a Progressive Leasing data breach payout?
Class members must meet the following criteria:
- They are a living individual residing in the United States.
- They received a notice from Prog Leasing LLC on or about Oct. 23, 2023 indicating their personal information may have been involved in the data incident that occurred on or around Sept. 11, 2023.
How much can class members get?
Class members have the following benefit options:
- Reimbursement for documented losses: Class members can claim up to $5,000 for losses that are fairly traceable to the data incident and not already reimbursed by another source. - California statutory payment: Class members who resided in California on Sept. 11, 2023, at the time of the data breach, can submit a claim to receive a pro rata statutory cash payment of up to $100. The settlement administrator will determine the final payment amount by the number of valid claims.
- Residual cash payment: Class members who do not claim documented losses or a California statutory payment can submit a claim to receive a pro rata residual cash payment of up to $400. The settlement administrator will determine the final payment amount by the number of valid claims.
- Credit monitoring: All class members may elect to receive two years of three-bureau credit monitoring services. This includes credit monitoring and alerts, dark web monitoring, $1 million in reimbursement insurance, identity restoration services, member advisory services, lost wallet assistance and immediate support.

Why is there a class action settlement?
The class action lawsuit alleged a third party gained unauthorized access to Progressive Leasing's systems, potentially exposing customers' personal information. The plaintiffs claimed that Prog Leasing LLC failed to maintain adequate data security, resulting in the exposure of sensitive information.
The company denies the allegations but agreed to settle to avoid the uncertainty and expense of further litigation and a possible trial.
