PCR Store 501 LLC, operating as Wingstop, agreed to pay up to $90,000 to settle a class action lawsuit alleging violations of New York wage-and-hour laws, including claims for unpaid shift change premiums and uniform maintenance pay.
Who can file a claim?
Individuals are considered class members and may file a claim if they meet all of the following criteria:
- They worked at Wingstop Store 501, located at 905 White Plains Road, Bronx, NY 10473.
- Their employment occurred at any time between Dec. 1, 2020, and Feb. 2, 2024.
- They held a nonexempt position as a crew member, assistant manager or shift leader.
The settlement administrator identified potential class members based on Wingstop’s employment records and sent them notices. However, those who did not receive a notice but believe they meet the criteria may contact the settlement administrator for more information.
How much can class members receive?
The total settlement fund is $90,000. After deductions for attorneys’ fees, costs, service awards and administration expenses, the settlement administrator will distribute the remaining funds to class members who submit valid claims. The amount each class member receives is based on the number of weeks they worked at Wingstop Store 501 during the settlement period.
The calculation works as follows:
- The settlement administrator determines the total number of weeks all class members worked during the settlement period.
- It divides each individual’s number of weeks worked by the total weeks all customers worked to determine their percentage share.
- It then multiplies the net settlement fund (after deductions) by each individual’s percentage share to determine their payment.
The settlement administrator can provide an individualized estimate if class members contact it directly.
