Who can file a claim?
The settlement class includes:
- All individuals whose personally identifiable information the September 2024 data incident potentially compromised
- Anyone who received a notification letter from Constar Financial Services or Empereon Marketing regarding the data breach

How much can class members get?
Class members may claim several types of benefits, depending on their circumstances. The available benefits include:
- Reimbursement for lost time: Class members who spent time responding to the data incident may claim up to four hours of lost time at $20 per hour for a maximum of $80. They must briefly describe how they spent this time.
- Reimbursement for documented ordinary expenses: Class members may claim up to $1,000 for documented out-of-pocket expenses related to the data incident, such as fees for credit reports or monitoring, costs to replace IDs or postage to contact banks. They must have incurred the expenses between Sept. 27, 2024, and May 1, 2026. Class members must provide receipts or other documentation.
- Reimbursement for documented extraordinary losses: Class members who suffered identity theft or fraud the data incident likely caused may claim up to $5,000 for unreimbursed losses. They must show other reimbursements did not already cover the loss, that they attempted to recover the loss (such as by using insurance) and that the loss occurred between Sept. 27, 2024, and May 1, 2026. Class members must provide supporting documentation.
- Credit monitoring: All class members are eligible to enroll in three years of credit monitoring services provided by a credit bureau. This includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring. If the system detects suspicious activity, class members will have access to a fraud resolution agent.
How to claim a settlement payment
Class members can file a claim online or download and print a PDF claim form to complete and mail or email to the settlement administrator. The claim deadline is May 1, 2026.

What proof or documentation is required to submit a claim?
- To file an online claim form, class members must log in with the unique ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@EmpereonConstarDataSettlement.com and providing their full name and mailing address.
- To file a lost time claim, class members must provide a brief description of how they spent the time.
- To file an out-of-pocket expenses or extraordinary losses claim, class members must provide receipts or other documentation to show the amount they spent or lost. Self-written notes or papers are not sufficient alone but may supplement other documentation.
- To file a credit monitoring claim, class members need only select the appropriate option.
