Individuals who received notice from Oklahoma Spine Hospital about the July 2024 data breach may be eligible to submit a claim for up to $10,000 from a class action settlement. The settlement includes approximately 38,945 class members.

Oklahoma Spine Hospital LLC agreed to pay $1.1 million to settle a class action lawsuit regarding a data breach that potentially exposed sensitive personal, financial and protected health information.

Who is eligible for a data breach payout?

Class members must meet the following criteria:

  • They received a data breach notice from Oklahoma Spine Hospital regarding the cybersecurity incident discovered on or around July 1, 2024.
  • The notice informed them that the breach may have impacted their personal information.

How much will the settlement payment be?

Class members can select one or more of the following benefits:

  • Credit monitoring services: All class members can elect to receive three years of credit monitoring services, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning, public records monitoring and access to fraud resolution agents for suspicious activity.
  • Cash payment for documented losses: Class members can claim up to $10,000 for actual, documented out-of-pocket losses that are traceable to the data breach and occurred between July 1, 2024, and Jan. 7, 2026. Covered losses include:
    • Losses from identity theft or fraud
    • Fees for credit reports, credit monitoring or freezing/unfreezing credit
    • Costs to replace identification documents
    • Postage to contact banks or other institutions by mail
  • Pro rata cash payment: All class members can also submit a claim to receive a pro rata cash payment from the remaining after all other fees and claims are paid. The settlement administrator will determine the final payment amount by the total number of valid claims filed.

How to claim a class action rebate

To receive a settlement payment, class members must submit a claim. Class members can file a claim online or print and mail or email the PDF claim form to the settlement administrator.

Required proof and claim information

  • To submit an online claim, class members must provide the notice ID and PIN from their settlement notice.
  • To submit a documented loss claim, class members must provide supporting documentation, such as bank or credit card statements, receipts, invoices or other third-party records to show their out-of-pocket expenses and monetary losses due to identity theft or fraud.

$1.1 million data breach settlement fund

The $1,100,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Up to $366,666.67
  • Service awards to class representatives: $2,500 each
  • Credit monitoring services: Cost determined by the number of valid claims filed
  • Payments to approved claimants: Remaining settlement funds

  • Opt-out deadline: Dec. 8, 2025
  • Claim deadline: Jan. 7, 2026
  • Final approval hearing: Feb. 17, 2026

When is the Oklahoma Spine Hospital data breach settlement payout date?

The settlement administrator will issue payments and credit monitoring codes to approved claimants 70 days after after the court grants final approval of the settlement or within 21 days of the date the administrator approves the claim, whichever is later.

Why is there a class action settlement?

The class action lawsuit alleged Oklahoma Spine Hospital experienced a data breach in July 2024 that may have exposed sensitive personal, financial and protected health information. The plaintiffs alleged that the hospital failed to adequately protect this information.

Oklahoma Spine Hospital denies any wrongdoing but agreed to settle to avoid the expense and uncertainties of further litigation and a possible trial.
