Individuals whose personal information the November 2023 American Vision Partners data breach compromised may be eligible to claim a cash payment from a class action settlement.
Medical Management Resource Group LLC d/b/a American Vision Partners agreed to pay $1.75 million to settle a class action lawsuit alleging it failed to protect personal and health information during a November 2023 data breach that potentially exposed sensitive data, including Social Security numbers.
Who can file a claim?
There are two groups of class members in this settlement.
- Damages settlement class members: This group includes about 258,070 U.S. residents whose Social Security numbers and other personal information the November 2023 data breach compromised. Individuals in this group are eligible to submit a claim for either a pro rata cash payment or reimbursement for documented out-of-pocket expenses related to the breach.
- Injunctive relief class members: This broader group includes all individuals whose personal information American Vision Partners collects or maintains. Members of this class are not eligible for direct monetary compensation but will benefit from the company’s commitment to improved cybersecurity practices.
How much are settlement payouts?
Damages settlement class members can choose one of two options:
- Out-of-pocket expense reimbursement: Class members can claim up to $3,000 for documented losses that are reasonably and fairly traceable to the data breach, such as costs for credit monitoring, freezing or unfreezing credit and ID replacement.
- Pro rata cash payment: Class members can claim a share of the $1.75 million settlement fund, which. the settlement administrator will divide equally among all valid claimants after deductions for attorneys’ fees and costs, service awards and administration costs.
How to claim a settlement payment
To receive compensation, damages settlement class members can submit an online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator.

What proof or documentation is required to submit a claim?
- Individuals claiming reimbursement for out-of-pocket expenses must submit documentation, such as receipts, bills or other records, showing the loss was reasonably and fairly traceable to the data breach. Self-prepared documents alone are not sufficient but may supplement other documentation.
- Individuals claiming a pro rata cash payment must certify that they are a class member.
- Individuals using the online claim form must provide the claim number ID they received in their settlement notice.

$1.75 million settlement fund
The $1,750,000 settlement fund includes:
- Settlement administration costs: Amount not specified
- Attorney's fees: Up to $58,327,500 plus litigation costs
- Service awards to class representatives: Up to $2,500 each ($37,500 total)
- Payments to eligible class members: The remainder of the fund

When is the American Vision Partners settlement payout date?
The settlement administrator will issue payments after the court resolves any appeals and the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged a cyberattack in November 2023 exposed the personal and health information of about 1.6 million individuals. The plaintiffs claimed the company failed to adequately protect sensitive data, including Social Security numbers and health information.
American Vision Partners denied any wrongdoing but agreed to settle to avoid the cost and risk of further litigation.
