Employees who worked for Olympus America as a sales representative and participated in new hire sales training during their initial employment may qualify to claim a monetary award from a class action settlement.

Olympus America agreed to pay up to $495,000 to settle a lawsuit alleging it misclassified certain sales representatives as overtime-exempt during their training period, resulting in unpaid overtime wages.

Who can file a claim?

Class members must meet the following criteria:

  • They worked for Olympus America as a sales representative, which includes as a territory manager, associate territory manager or sales specialist.
  • They participated in new hire sales training during their initial period of employment.
  • They completed this training:
    • In California: Between Dec. 9, 2020, and July 7, 2025
    • Anywhere else in the United States: Between July 1, 2022, and July 7, 2025

How much can class members get?

The total settlement fund is $495,000. The amount each class member receives depends on the number of weeks they worked as a sales representative engaged in new hire sales training during the covered period. The settlement administrator will use Olympus America’s records to determine the number of eligible training weeks for each participant.

After deducting court-approved attorneys’ fees, costs, and other approved payments, the settlement administrator will distribute the remaining funds to eligible class members.

The formulas are:

  • Net settlement fund/total number of eligible training weeks=award per training week
  • Number of training weeks x award per week=Individual award

Half of each payment will be treated as wages and subject to standard payroll tax withholdings (reported on a W-2). The other half will be reported as non-wage income on a 1099 form.

How to claim a settlement payment

Eligible class members can complete the online claim form or download, print and complete the PDF claim form to mail or email to the settlement administrator. The claim deadline is Dec. 2, 2025.

To file an online claim, claimants must provide the ILYM ID located on the bottom right-hand corner of the class notice and claim form they received, as well as their last name.

Payout options

The settlement administrator will issue payments by paper check. If the class member does not cash the check with 120 days, it will be void.

$495,000 settlement fund breakdown

The $495,000 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: $165,000
  • Attorneys' costs: $9,715.80
  • General release payments: $10,000 to two recipients ($20,000 total)
  • Payments to eligible class members: The remainder of the fund

When is the Olympus America settlement payout date?

Eligible class members who submit a valid claim will receive their payment approximately five months after they submit their claim form and the settlement administrator resolves all appeals.

Why is there a class action lawsuit?

The class action lawsuit alleged Olympus America misclassified sales representatives as overtime-exempt employees during their new hire sales training, resulting in unpaid overtime for hours worked more than 40 per week, including time spent reviewing training materials and studying for exams at home.

Olympus America denied any wrongdoing, but the parties reached the settlement to avoid the costs, delays and risks of further litigation.
