Individuals who received a notice that the August 2024 OBI Seafoods data incident compromised their private information may be eligible to claim a cash payment and/or medical data monitoring from a class action settlement.

OBI Seafoods LLC agreed to pay $380,280 to settle a class action lawsuit alleging it failed to protect personal information during a targeted cyberattack in August 2024. The incident resulted in unauthorized access to files containing sensitive data, including Social Security numbers, medical information and bank account details.

Who can file a claim?

Class members include all individuals residing in the United States who received notice that the August 2024 OBI Seafoods data breach affected their information.

How much can class members get?

The settlement provides two main types of benefits: medical data monitoring and cash payments:

  • Cash payment A – documented losses: Class members who experienced actual, documented out-of-pocket losses between Aug. 16, 2024, and Aug. 20, 2026, due to the data incident can claim up to $5,000. Eligible expenses include:
    • Losses due to identity theft or fraud
    • Fees for credit reports, credit monitoring or freezing/unfreezing credit
    • Costs to replace IDs
    • Postage for contacting banks by mail
  • Cash payment B – alternative cash: Class members who did not experience or cannot document out-of-pocket losses can claim a one-time pro rata cash payment without documentation.
  • Credit monitoring: All class members are eligible for one year of CyEx Medical Shield Complete, which includes:
    • $1 million in medical identity theft insurance
    • Monitoring for health care insurance ID exposure
    • Monitoring for medical record number exposure
    • Monitoring for unauthorized health savings account spending
    • Access to fraud resolution agents if the program detects suspicious activity

How to claim a settlement payout

To receive a payment or enroll in medical data monitoring, class members can file a claim online or download and print a PDF claim form, fill it out and mail it to the settlement administrator.

What proof or documentation is necessary to submit a claim?

  • Cash payment A – documented losses: Class members must provide documentation, such as bank statements, receipts or other supporting evidence. They may submit self-prepared notes or papers to explain or support other proof, but these are not sufficient on their own. Expenses a third party (like a bank or credit card issuer) already reimbursed are not eligible.
  • Cash payment B - alternative cash and medical data monitoring: No documentation is required. Individuals only need to attest they are a class member and choose the correct option on the claim form.

$380,280 settlement fund

The $380,280 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $126,760
  • Attorneys' expenses: To be determined
  • Service awards to class representatives: $2,500 each for three representatives ($7,500 total)
  • Payments to approved class members: Remaining funds

When is the OBI Seafoods data breach settlement payout date?

The settlement administrator will distribute payments after the court resolves any appeals and grants final approval to the settlement.

The class action lawsuit alleged OBI Seafoods failed to adequately protect private information during a cyberattack in August 2024, resulting in unauthorized access to files containing sensitive data.
