Patients who paid one or more fees to Ciox Health LLC between Oct. 1, 2016, and July 11, 2025, that the Maryland’s Confidentiality of Medical Records Act did not permit may be eligible to claim approximately $45.76 per eligible transaction from a class action settlement.
Ciox Health LLC, which merged with Datavant in 2021, agreed to pay $4.5 million to settle a class action lawsuit alleging it charged individuals, law firms and certain companies improper fees for copies of medical records in violation of Maryland law. The lawsuit claimed Ciox imposed unauthorized charges, including fees when it did not locate records, excessive per-page rates and other fees not allowed by statute.
Who can file a claim?
The settlement class includes individuals and law firms (including solo practitioners), as well as certain copying services and insurers, who, between Oct. 1, 2016, and July 11, 2025:
- Requested copies of medical records from a Maryland health care provider or whose records someone else with their authorization requested
- Paid (and, for law firms, did not receive reimbursement for) one or more of the following eligible fees:
- Any fee Ciox charged after it determined no medical records existed (the “no records found” or “NRF” fee)
- Fees for requests where Ciox produced records but the amounts charged exceeded the per-page rates or aggregate caps set by Maryland law
- One or more of the following fees: retrieval fee, sales tax, electronic delivery fee or certification fee
For law firms, copying services and insurers, claims are only eligible if the class member paid the fee on behalf of an individual and did not receive reimbursement. If a law firm paid multiple NRF fees for different clients and did not receive reimbursement, it can file a claim for each transaction.
Individuals can submit a claim for fees they paid directly or reimbursed to their lawyer. The settlement considers each invoice with an eligible fee a separate claim.
How much can class members get?
The settlement allocates $45.76 per eligible transaction. The settlement administrator may adjust the final amount depending on the total number of valid claims submitted.

To receive compensation, class members must submit a claim form for each eligible invoice. They can submit the online claim form or request a paper claim form from the settlement administrator by calling 866-274-4004. Class members should mail completed paper forms to the settlement administrator.
