Nucor Corp. Data Breach Class Action Settlement

Individuals who received a written notice from Nucor Corp. in or around June 2025 informing them a data incident affected their personal information may be eligible to claim up to $8,200 from a class action settlement.

Nucor Corp. agreed to resolve a class action lawsuit alleging a cybersecurity incident exposed certain personal information. The lawsuit claimed Nucor failed to adequately protect personal data.

Who can file a claim?

Individuals must meet the following criteria:

  • They received a written notice from Nucor in or around June 2025 regarding the data incident the company discovered around May 13, 2025.
  • The notice stated the data incident may have involved their personal information.
  • The official class list maintained the settlement administrator maintains based on Nucor’s records includes their name.

How much can class members receive?

The settlement provides several types of compensation, depending on the losses or expenses the class member experienced as a result of the data incident. There is a total cap of $200,000 for the entire class. If class member claims exceed this amount, the settlement administrator may reduce payments proportionally.

  • Documented out-of-pocket expenses: Up to $700 per person for documented, unreimbursed out-of-pocket expenses that are fairly traceable to the data incident. Eligible expenses include:
    • Bank fees
    • Long-distance telephone charges
    • Cell phone charges (if charged by the minute or data usage)
    • Postage
    • Gasoline for local travel
    • Fees for credit reports, credit monitoring or other identity theft insurance products purchased between the date of the incident and the claim deadline
  • Lost time reimbursement: Up to three hours of lost time at $25 per hour (maximum $75) for time spent remedying issues related to the data incident. The settlement includes the lost time reimbursement in the $700 out-of-pocket expenses cap.
  • Extraordinary out-of-pocket expenses: Up to $7,500 per person for documented, unreimbursed losses due to actual identity theft resulting from the data incident. Class members must provide sufficient proof of identity theft and its connection to the Nucor incident. Eligible losses include:
    • Documented professional fees and other costs incurred to address actual identity fraud or theft
    • Other documented unreimbursed losses, such as unreimbursed bank fees, card re-issuance fees, overdraft fees, charges related to unavailability of funds, late fees, overlimit fees, charges from banks or credit card companies and interest on payday loans due to card cancellations or overlimit situations
  • Credit monitoring services: Class members who did not previously enroll in the two-year Equifax Complete Premier credit monitoring offered by Nucor can claim a new 24-month subscription at no cost.

How to claim a settlement payment

Class members can submit the online claim form or download and print the PDF claim form, complete it and mail it to the settlement administrator. The claim deadline is June 9, 2026.

What proof or documentation is required to submit a claim?

  • For out-of-pocket and extraordinary expenses, claimants must provide documentation, such as receipts, bank statements or other proof of loss.
  • For lost time, claimants must provide a written attestation and description.
  • For credit monitoring, claimants must attest that they did not previously enroll.
  • For online claims, claimants must provide the login and password from the settlement notice they received.

Payout options

The settlement administrator will mail paper checks to the addresses provided on class member claim form. It will send credit monitoring enrollment instructions by email.

The settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Up to $100,000
  • Service award to class representative: Up to $2,000
  • Payments to approved class members: Up to $200,000

Important dates

When is the Nucor data settlement payout date?

The settlement administrator will issue payments to eligible class members no later than 30 days after it approves the last claim or 60 days after the court resolves any appeals and grants final approval to the settlement, whichever is later.

Why did Nucor settle this lawsuit?

The class action lawsuit claimed Nucor discovered a cybersecurity incident in May 2025 in which unauthorized third parties accessed certain data, including personal information.

While Nucor denies any wrongdoing, the company agreed to settle to avoid the expense and uncertainty of further litigation and to provide compensation to those affected.
