NTN Bearing Corp. of America agreed to pay $1,427,500 to settle a class action lawsuit alleging it violated Illinois law by requiring job applicants to disclose family medical history information during preemployment medical or physical examinations.
Who are the class members?
The settlement class includes approximately 550 individuals who meet all of the following criteria:
- They applied for employment with NTN Bearing Corp. of America, NTN USA Corp. or American NTN Bearing Manufacturing Corp. in Illinois.
- They underwent a medical or physical examination between June 19, 2019 and Dec. 20, 2024.
- Medical staff collected their family history or other genetic information during that examination.
How much can class members receive?
Each class member will receive an equal share of the settlement fund after deductions for attorneys’ fees, litigation costs, settlement administration costs and service awards to the class representatives. The anticipated minimum payment per class member is at least $1,500, but the final amount will depend on the number of participating class members and the total deductions.
No action needed to receive payment
Class members do not need to file a claim or take any action to receive payment. Those who moved or need to update their address should contact the settlement administrator.
Class members who wish to exclude themselves from the settlement must do so by mail by May 15, 2026. They should write a letter including their full name, current address, email, phone number, a statement indicating they wish to exclude themselves and their signature.
