
Consumers who received a notification from Montlick & Associates P.C. stating the January 2024 data incident may have compromised their private information could be eligible to claim up to $3,500 from a class action settlement.
Montlick & Associates P.C. agreed to pay $375,000 to settle a class action lawsuit alleging a targeted cyberattack exposed sensitive personal information.
Who can file a claim?
Class members must meet the following criteria:
- The January 2024 Montlick & Associates P.C. data incident compromised their private information.
- They received an individual notification from Montlick & Associates P.C. stating the data incident affected them.
How much can class members receive?
Class members can claim one cash payment option per person, as well as credit monitoring services:
- Cash Payment A – Lost time: Class members who spent time responding to the data incident can claim up to five hours of lost time at $20 per hour for a maximum of $100.
- Cash Payment B – Out-of-pocket expenses: Class members who incurred documented out-of-pocket expenses as a result of the data incident can claim up to $500. Eligible expenses include fees for credit reports, credit monitoring, freezing or unfreezing credit, replacing IDs or postage. Class members must provide receipts or other documentation.
- Cash Payment C – Losses for identity theft or fraud: Class members who suffered monetary losses due to identity theft or fraud the data incident likely caused can claim up to $3,500. They must show out-of-pocket expenses do not already cover the loss and that they attempted to recover the loss through insurance or other means. Class members must provide documentation, such as receipts or bank statements.
- Cash Payment D – Alternative cash payment: Class members who do not wish to claim any of the above may opt for a one-time cash payment. This payment is estimated at $35 but may be higher or lower depending on the number of valid claims filed. No documentation is required for this option.
- Credit monitoring services: Two years of credit monitoring from all three credit bureaus, including $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring. This service is available to all class members who request it.
How to claim an award
Class members can file a claim online or download a PDF claim form, print it, complete it and mail it to the settlement administrator.
They may also email the completed form or request a paper copy by calling the toll-free number below. The deadline to submit a claim is March 11, 2026.

What proof or documentation is necessary to submit a claim?
- To file an online claim, class members must log in with the login ID and PIN located on the settlement notice they received. Those who received a postcard notice can find their ID and PIN in the top left corner of the second page.
- To file a lost time claim, class members must describe the time they spent on tasks related to the data incident.
- To file an out-of-pocket expenses and/or identity theft/fraud claim, class members must provide receipts, bank statements or other documentation.
- To file an alternative cash payment claim, class members do not need to provide documentation.
Payout options
- Class members who submit their claim by mail will receive a paper check.
- Class members who submit their claim online have the option to receive a digital payment.

The $1,300,000 settlement fund includes:
- Settlement administration costs: To be determined
- Attorneys' fees and costs: Up to $375,000
- Service awards to class representatives: Up to $2,500 each
- Credit monitoring costs: Dependent on number of claims
- Payments to eligible class members: The remainder of the fund

When is the Montlick & Associates P.C. data incident settlement payout date?
The settlement administrator will issue payments approximately 90 days after the court resolves any appeals and grants final approval to the settlement.
Why did this class action settlement happen?
The class action lawsuit alleged a targeted cyberattack on Montlick & Associates P.C.’s computer systems in January 2024 resulted in unauthorized access to files containing sensitive personal information, including names, Social Security numbers, driver’s license numbers and medical information. The plaintiffs claimed Montlick & Associates P.C. failed to adequately safeguard this data.
The company denies any wrongdoing but agreed to settle to avoid the costs, risks and uncertainties of continued litigation.
