Missouri Fiesta Inc. agreed to pay $526,500 to settle a class action lawsuit alleging it violated the Illinois Biometric Information Privacy Act. The lawsuit claimed the company collected employee fingerprint data without providing the required written notice, obtaining written consent or issuing a written biometric policy as mandated by Illinois law.
Who can file a Missouri Fiesta claim?
Class members must meet all of the following criteria:
- Missouri Fiesta Inc. or W&M Restaurants Inc. employed them in in Illinois.
- They used a Par Tech Inc. point-of-sale system with a finger scanner.
- Their employment and use of the system occurred between March 21, 2019, and Aug. 31, 2022.
There are approximately 651 class members.
How much can class members receive?
The total settlement fund is $526,500. Before the settlement administrator distributes payments to class members, it will deduct attorneys' fees and litigation costs, a service award to the class representative and settlement administration costs. It will then distribute the remaining amount equally among all class members who submit valid claim forms and do not opt out.
Each eligible class member who submits a valid claim form will receive an estimated gross payment of $808.75, but the actual amount may vary depending on the number of valid claims submitted.
How to claim a settlement payment
Class members must download, print, fill out and mail the PDF claim form to the settlement administrator. There is no online claim form. The claim deadline is Oct. 4, 2025.

When is the Herman v. Missouri Fiesta Inc. payout date?
