
Individuals whom Mile Hi Foods Co. notified about a September 2024 data security incident may be eligible to claim up to $3,500 from a class action settlement.
Mile Hi Foods Co. agreed to pay up to $400,000 to resolve a class action lawsuit alleging a data breach that occurred around Sept. 13, 2024, compromised the private information of its current and former employees, such as names and Social Security numbers.
Who can file a claim?
Class members must meet the following criteria:
- The September 2024 data incident involving Mile Hi Foods Co. potentially compromised their private information.
- They received a mailed notice from Mile Hi Foods Co. regarding the data breach.
- They are a current or former employee of Mile Hi Foods Co.
How much can class members get?
- Ordinary losses: Reimbursement up to $500 per person for documented out-of-pocket expenses fairly traceable to the data incident. Examples include unreimbursed losses from fraud or identity theft, credit monitoring costs, bank fees, postage and travel costs.
- Extraordinary losses: Reimbursement up to $3,000 per person for documented, unreimbursed monetary losses the data incident most likely caused. The loss must have occurred between the incident date and the claim deadline and not be covered by other categories. The claimant must also have made reasonable efforts to avoid or recover the loss (including using available insurance).
- Alternative cash payment: As an alternative to claiming ordinary or extraordinary losses, class members can claim a cash payment of up to $50. The settlement administrator may reduce the final amount on a pro rata basis depending on the number of valid claims and the total funds available.
- Credit monitoring services: All class members may enroll in two years of one-bureau credit monitoring.
How to claim a class action payment
Class members can file the online claim form or download, print, complete and mail the PDF claim form. The claim deadline is Jan. 13, 2026.

Information required to submit a claim
- All class members must provide the CPT ID from their settlement notice to submit a claim. Those filing an online claim must also provide the passcode from the same notice. Class members who did not receive or cannot locate their settlement notice should email MileHiSettlement@cptgroup.com.
- For ordinary loss claims, class members must provide receipts, bank or credit card statements, invoices or other proof of out-of-pocket expenses.
- For extraordinary loss claims, class members must provide documentation of the loss, such as charges for professional fees, proof of identity theft or fraud, and evidence of efforts to recover the loss.
- No documentation is required to claim the alternative cash payment or credit monitoring.

The settlement administrator will send credit monitoring enrollment codes by mail or email after the settlement is final.
$400,000 million settlement fund
The $400,000 settlement fund covers:
- Settlement administration costs: To be determined
- Attorneys' fees, costs and expenses: Up to $110,000
- Service award to class representative: Up to $5,000
- Credit monitoring costs: Dependent on number of valid claims
- Payments to eligible class members: The remainder of the fund
If the total of all claims, fees and costs exceeds $400,000, the settlement administrator will reduce payments to class members proportionally.
Important dates
- Deadline to opt out of the settlement: Dec. 14, 2025

- Final fairness approval hearing: Mar. 16, 2026
When is the Mile Hi Foods Co. settlement payout date?
The settlement administrator will distribute payments and benefits approximately 45 days after the court grants final approval of the settlement and resolves any appeals.
