Manitou Equipment $487,500 Data Breach Settlement

Individuals who lived in the United States and whose personal information the December 2023 Manitou Equipment America and Manitou North America data breach compromised may be eligible to submit a claim for a cash payment from a class action settlement. The breach affected an estimated 12,003 individuals.

Manitou Equipment America LLC and Manitou North America LLC agreed to pay $487,500 to settle a class action lawsuit. The lawsuit alleged that a targeted cyberattack in December 2023 resulted in unauthorized access to files containing sensitive personal information, including names, dates of birth, Social Security numbers, credit and debit card numbers, medical history, financial account details and tax identification numbers.

Who can receive a data breach payment?

Class members must meet the following criteria:

• They reside in the United States.
• The December 2023 security incident compromised involving Manitou Equipment America LLC and Manitou North America LLC their personal information.
• They received notice of the data breach.

How much is the class action settlement payout?

Pro rata cash payment: Eligible class members will receive an equal share of the net settlement fund after deductions for fees, costs and awards.

No claim form required

Class members do not need to file a claim to receive a payment.

Payout options

• Check mailed to the address on file (default payment)
• Class members can request a digital payment via PayPal, Venmo, Zelle or prepaid card by submitting the payment election form on the settlement website.
• To submit a digital payment election, class members must provide the unique ID and PIN from their settlement notice.

$487,500 data breach settlement fund

The settlement fund of $487,500 will include:

• Settlement administration costs: To be determined
• Attorneys’ fees and expenses: Not to exceed $162,483.75
• Service awards to class representatives: Not to exceed $5,000 each ($15,000 total)
• Payments to eligible class members: Remaining settlement funds

• Fairness hearing: March 5, 2026

When is the Manitou Equipment data breach settlement payout date?

The settlement administrator will distribute payments to eligible class members approximately 61 days after the settlement receives final court approval.

Why is there a class action settlement?

This class action lawsuit alleged a targeted cyberattack on Manitou’s computer systems in December 2023 compromised files containing sensitive personal information. The plaintiffs claimed that Manitou failed to adequately protect this information.
