Manitou Equipment $487,500 Data Breach Settlement

Individuals who lived in the United States and had their personal information compromised in the December 2023 Manitou Equipment America and Manitou North America data breach, may be eligible to submit a claim for a cash payment from a class action settlement. There were an estimated 12,003 individuals affected by the data breach.

Manitou Equipment America LLC and Manitou North America LLC have agreed to pay $487,500 to settle a class action lawsuit. The lawsuit alleged that a targeted cyberattack in December 2023 resulted in unauthorized access to files containing sensitive personal information, including names, dates of birth, Social Security numbers, credit and debit card numbers, medical history, financial account details, and tax identification numbers.

Who can receive a data breach payment?

Class members must meet the following criteria:

• They reside in the United States whose personal information was compromised in the December 2023 security incident involving Manitou Equipment America LLC and Manitou North America LLC.
• They received notice of the data breach from Manitou.

How much is the class action settlement payout?

Pro rata cash payment: Eligible class members will receive an equal share of the net settlement fund, after fees, costs and awards are deducted.

No claim form required

Class members do not need to file a claim to receive a payment.

• Class members can request a digital payment via PayPal, Venmo, Zelle, or prepaid card by submitting the payment election form on the settlement website.
• Unique ID and PIN from settlement notice required to submit a digital payment election.

$487,500 data breach settlement fund

The settlement fund of $487,500 will include:

• Settlement administration costs: To be determined
• Attorneys’ fees and expenses: Not to exceed $162,483.75
• Service awards to class representatives: Not to exceed $5,000 each, $15,000 total
• Payments to class members: Remaining settlement funds

When is the Manitou Equipment data breach settlement payout date?

Payments will be distributed to eligible class members approximately 61 days after the settlement receives final court approval.
