
If your private information may have been exposed to unauthorized third parties as a result of a data incident at Liberty Hospital, you may be eligible to claim up to $500 for documented losses or an estimated $150 cash payment from a class action settlement.
Liberty Hospital has agreed to pay $1.5 million to settle a class action lawsuit regarding allegations that an unauthorized threat actor accessed its computer network on or about Dec. 19, 2023, potentially exposing sensitive information of patients and others.
The company denies any wrongdoing but has agreed to the settlement to resolve the dispute and avoid further litigation costs and disruptions.
Who can claim benefits from the data breach settlement?
According to the official settlement website, you are eligible to participate in this settlement if:
- You are an individual residing in the United States
- Your private information was potentially exposed to unauthorized third parties as a result of the data incident experienced by Liberty Hospital on Dec. 19, 2023
The types of private information that may have been affected include:
- Name
- Address
- Date of birth
- Medical records
- Medical treatment information
- Diagnoses
- Social Security number
- Telephone number
- Health insurance information
- Email address
If you received a notice about the data incident, you are likely included. If you are unsure about your eligibility, you can contact the settlement administrator by mail, email, or phone for assistance.
How much can class members get?
Class members can claim one of two types of cash benefits:
- Documented Expenses and Losses: Up to $500 for unreimbursed, documented out-of-pocket expenses and financial losses fairly traceable to the data incident. Eligible expenses include:
- Costs, losses, or expenditures relating to fraud or identity theft
- Professional fees (accountants, credit repair services)
- Costs for freezing or unfreezing credit with credit reporting agencies
- Credit monitoring costs incurred after the data incident
- Miscellaneous expenses (notary, fax, postage, copying, mileage, long-distance calls)
- Alternative Cash Payment: An estimated $150 cash payment. The final amount may be higher or lower depending on the number of valid claims and the total funds available. This is what's known as a pro rata adjustment.
How is the cash payment calculated?
The settlement fund available for payments to class members is the remainder after deducting attorneys’ fees, service awards, and administration costs from the $1.5 million fund. The cash payment amount is then divided among all valid claimants who select the alternative cash payment option.
Example calculation:
If the net settlement fund available for payments is $868,000 and 6,000 valid cash payment claims are submitted:
- $868,000 ÷ 6,000 = $144.66 per claimant
If more claims are filed, the payment per person decreases proportionally. If fewer claims are filed, the payment per person increases.
How to claim a settlement payment
To claim payment, class members must submit a valid and timely claim form.
There are two ways to file:
- Submit the online claim form

Claims must be submitted online or postmarked by Jan. 12, 2026.
If you are claiming documented expenses and losses, you must provide supporting documentation. This includes reasonable third-party documentation (such as receipts, statements, or other proof of actual, unreimbursed expenses). Self-prepared documents like handwritten notes are not sufficient by themselves but may supplement other documentation.
If you are claiming the alternative cash payment, you only need to attest to your eligibility.
Payout options
Class members can choose from several payment options:
- PayPal (provide your PayPal email address)
- Venmo (provide the mobile number associated with your Venmo account)
- Zelle (provide the mobile number or email address associated with your Zelle account)
- Virtual prepaid card (provide your email address)
- Physical check (mailed to the address provided in your claim form)
$1.5 million settlement fund
The settlement fund will cover all payments to class members, attorneys’ fees and expenses, service awards to class representatives, and settlement administration costs. Any remaining funds after payment of valid claims, fees, and costs will be distributed to a cy pres recipient approved by the court.
- Settlement administration costs: TBD
- Attorneys' fees: Up to $600,000 (subject to court approval)
- Attorneys' expenses: Up to $25,000 (subject to court approval)
- Service awards to class representatives: Up to $3,500 each (subject to court approval)
- Payments to class members: The remainder of the fund after the above deductions

When is the Liberty Hospital Data Incident Settlement payout date?
After the claim deadline on Jan. 12, 2026, the court will hold a final approval hearing on Jan. 20, 2026. If the settlement is approved and there are no appeals, payments will be distributed to eligible class members.
