
Men who applied for a nonmanagerial front-of-house position at Kickback Jack’s and whom the restaurant did not hire because of their sex may be eligible to claim a cash payment from a settlement.
Battleground Restaurants Inc. and Battleground Restaurant Group Inc., which operate Kickback Jack’s restaurants, agreed to pay $1,111,300 to settle a class action lawsuit brought by the Equal Employment Opportunity Commission. The lawsuit alleged the defendants engaged in a pattern or practice of intentionally failing to hire male applicants for nonmanagerial front-of-house positions because of their sex in violation of Title VII of the Civil Rights Act of 1964 and related statutes.
Who can file a claim?
Individuals must meet all of the following criteria:
- They are male.
- They applied for a nonmanagerial front-of-house position at any Kickback Jack’s restaurant owned or operated by Battleground Restaurants Inc. or Battleground Restaurant Group Inc.
- They submitted the application between Dec. 1, 2019, and Feb. 3, 2026.
- Kickback Jack's did not hire them for the position.
- Kickback Jack's did not hire them because of sex (male).
The EEOC will determine eligibility and the amount of any payment based on the information class members provide on the claim form and in any supporting documentation.
How much is the Kickback Jack's payout?
Pro rata payment: The total settlement fund is $1,111,300. The settlement designates the entire fund to payments to eligible claimants.
The settlement administrator will distribute this amount among eligible claimants the EEOC identifies. The exact amount each class member receives depends on the number of valid claims and the EEOC’s determination of each claimant’s eligibility and damages.

Class members can file a claim online or download the PDF claim form, print it, complete it and mail it to the settlement administrator. The claim deadline is Aug. 3, 2026.

Why is there a settlement?
The lawsuit alleged Kickback Jack’s, operated by Battleground Restaurants Inc. and Battleground Restaurant Group Inc., intentionally failed to hire male applicants for nonmanagerial front-of-house positions because of their sex. The EEOC brought the case under Title VII of the Civil Rights Act of 1964 and Title I of the Civil Rights Act of 1991.
The defendants deny any wrongdoing but agreed to the settlement to resolve the allegations without further litigation. The settlement also includes requirements for policy changes, training and recordkeeping to prevent future discrimination.
