Hy Cite Enterprises $4.75M TCPA Class Action Settlement

Individuals who received an artificial or prerecorded voice call on their cellular phone from Hy Cite Enterprises LLC (d/b/a Royal Prestige) between Oct. 22, 2020, and Sept. 10, 2025, and did not have an account with Hy Cite may be eligible to claim $600 to $1,000 from a class action settlement.

Hy Cite Enterprises LLC agreed to pay $4.75 million to settle a class action lawsuit alleging violations of the Telephone Consumer Protection Act. The lawsuit claimed Hy Cite used artificial or prerecorded voice calls to contact noncustomers’ cell phones without consent.

Who can file a claim?

An individual may be a class member if all of the following apply:

  • They received a call from Hy Cite Enterprises LLC between Oct. 22, 2020, and Sept. 10, 2025.
  • They were not a Hy Cite customer or accountholder at the time they received the call.
  • Hy Cite made the call to a telephone number assigned to a cellular telephone service.
  • The call used an artificial or prerecorded voice.

Hy Cite identified more than 22,000 unique phone numbers in its records.

How much can class members get?

Pro rata payment: Each class member who submits a valid and timely claim form will receive a share of the net settlement fund. The estimated payment per claimant is between $600 and $1,000, depending on the total number of valid claims submitted.

The settlement administrator will determine the final amount each claimant receives after deducting expenses, including settlement administration costs, attorneys’ fees, litigation expenses and a service award to the class representative, from the $4,750,000 fund and dividing the remainder equally among all approved claimants.

How to claim a class action payment

Eligible class members must complete the online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is July 8, 2026.

What proof or documentation is necessary to submit a claim?

  • All claimants must provide the phone number at which they received one or more calls from Hy Cite using an artificial or prerecorded voice during the settlement period and attest that they were not a Hy Cite customer when they received the call(s).
  • Online claimants must provide the class member ID from the settlement notice they received to log in to the website.

The settlement administrator will mail checks to valid claimants.

The $4,750,000 settlement fund includes::

  • Settlement administration costs: Estimated at $116,000
  • Attorneys’ fees: Up to $1,710,000
  • Attorneys’ expenses: Up to $15,000
  • Service award to class representative: Up to $15,000
  • Payments to eligible class members: Remainder of the fund

When is the Keith v. Hy Cite Enterprises LLC payout date?

The settlement administrator will mail payments no later than 30 days after court resolves any appeals and approves the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Hy Cite Enterprises LLC violated the TCPA by making artificial or prerecorded voice calls to cell phones of individuals who were not customers or accountholders. The TCPA allows for statutory damages of $500 to $1,500 per violation.

Hy Cite denies all allegations and any wrongdoing. The parties agreed to settle to avoid the uncertainty, expense and time of continued litigation.
