Inova Health $3.15M MyChart Privacy Class Action Settlement

Current and former patients or other individuals who visited an Inova public-facing website at any time from April 29, 2022, through April 29, 2024, and had an Inova MyChart account may be eligible to submit a claim for a cash payment from a class action settlement.

Inova Health Care Services agreed to pay $3,147,390.04 to settle a class action lawsuit alleging it improperly collected and disclosed patient information through third-party tracking pixels on its public websites to outside companies, such as Facebook and Google, without consent.

Who is eligible for a MyChart settlement payout?

Class members must meet the following criteria:

• They resided in the United States.
• They visited an Inova Health Care Services public-facing website at any time from April 29, 2022, through April 29, 2024.
• They had an Inova MyChart account during the qualifying period.
• Inova potentially disclosed their private information to third parties via Facebook Pixel, Google Pixel or similar tracking technologies without expressed consent.

How much is the class action payment?

Pro rata cash payment: Class members can submit a claim to receive an equal share of the net settlement fund. The settlement administrator will determine the final payment amount by the number of valid claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or download, print and complete the PDF claim form to mail to the settlement administrator.

Required claim information

• To submit a claim online, class members must provide the unique ID and PIN from the settlement notice they received.

$3.15 million Inova settlement fund

The $3,147,390.04 settlement fund will include:

• Settlement administration costs: To be determined
• Attorneys’ fees and expenses: Up to $1,038,639.71
• Service award to class representative: Up to $5,000
• Payments to approved claimants: Remaining settlement funds

• Deadline to opt out: Feb. 27, 2026
• Deadline to file a claim: April 6, 2026
• Final approval hearing: April 16, 2026

When is the Inova Health Care Services payout date?

The settlement administrator will distribute payments to eligible class members approximately 58 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged that Inova Health Care Services collected and disclosed patients’ personally identifiable and protected health information by using tracking pixels on its public websites, potentially without proper authorization. The plaintiff claimed this violated the federal Electronic Communications Privacy Act.

Inova denied the allegations but agreed to settle to avoid the uncertainties and costs of ongoing litigation and a possible trial. As a part of the settlement, Inova agreed to ensure its tracking pixel usage complies with ECPA and HIPPA.
