Current and former drivers who delivered for Grubhub as an independent contractor in California and completed at least one delivery between Dec. 3, 2014, and March 13, 2026, may be eligible to submit a claim for a cash payment from a class action settlement.

After 11 years of litigation, Grubhub Holdings Inc. has agreed to pay $24,750,000 to settle a class action lawsuit that alleged the company misclassified delivery drivers as independent contractors, failed to reimburse necessary business expenses, and did not pay minimum wage or overtime as required by California law.

Who can file a Grubhub claim?

Class members must meet the following criteria:

  • They a current or former driver who entered into an agreement with Grubhub to use the platform as an independent contractor to offer delivery services to customers.
  • They used the Grubhub platform as an independent contractor service provider to accept or complete at least one delivery in California between Dec. 3, 2014, and March 13, 2026.

How much will settlement payments be?

Pro rata cash payment: Class members can submit to receive a pro rata cash payment from the net settlement fund. Final payment amount will be determined by the number of miles driven during the qualifying period and the total number of claims filed. All claimants are guaranteed a payment of at least $25.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or complete the paper claim form included with their settlement notice to mail or email to the settlement administrator.

$24.75 million Grubhub settlement fund

The $24,750,000 settlement fund will include:

  • Settlement administration costs: Up to $260,000
  • Attorneys' fees and expenses: Up to $8,250,000
  • Service awards to class representatives: Up to $100,000 for Raef Lawson and $5,000 for Rejenna Marshall
  • PAGA payment: $2,000,000, 75% to the State of California, 25% to claimants
  • Payments to approved claimants: Remaining settlement funds

When is the Grubhub driver settlement payout date?

Payments will be issued to approved claimants approximately 60 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged that Grubhub misclassified delivery drivers as independent contractors rather than employees, failed to reimburse business expenses, and did not pay minimum wage or overtime as required by California law. Grubhub denied all allegations, however agreed to settle to avoid the risks and uncertainty of further litigation.
