Individuals who bought an electronic ticket to Gotham Comedy Club through its website and paid a service charge between Aug. 29, 2022, and May 17, 2024, may be eligible to claim up to $4.50 per ticket from a class action settlement.

Gotham Comedy Foundation Inc. agreed to pay $716,389 to settle a class action lawsuit alleging it failed to properly disclose service charges for online ticket purchases, potentially violating New York law.

Who can file a claim?

Class members must meet all of the following criteria:

  • They purchased an electronic ticket to Gotham Comedy Club in New York City.
  • They purchased the ticket through the Gotham Comedy Club website.
  • They purchased the ticket between Aug. 29, 2022, and May 17, 2024.
  • They paid a service charge as part of the ticket purchase.

How much can class members get?

Class members who submit a valid claim form may receive a cash payment equal to the total amount of service charges they paid for eligible ticket purchases. The maximum payment is $4.50 per ticket.

For example:

  • If a class member bought one ticket, they can claim up to $4.50.
  • If a class member bought two tickets, they can claim up to $9 (2 x $4.50).
  • If a class member bought four tickets, they can claim up to $18 (4 x $4.50).

How to claim a class action rebate

Class members can complete the online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. The claim form deadline is Dec. 30, 2025.

Required information

To file an online claim, class members must log in using the notice ID and PIN located on the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@GothamComedyClubTicketFeeSettlement.com or calling 833-417-4919 and providing their full name and mailing address.

The $716,389 settlement fund covers:

When is the Gotham Comedy Club ticket fee settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 70 days after the settlement receives final court approval.

Why is there a class action settlement?

The class action lawsuit claimed Gotham Comedy Foundation Inc. failed to properly disclose service charges for tickets sold through its website, allegedly violating New York Arts and Cultural Affairs Law § 25.07(4).

The defendant denies any wrongdoing but agreed to settle to avoid further litigation and provide compensation to affected customers. As part of the settlement, the company also agreed to comply with the law regarding fee disclosures.
