Goshen Health Patient Privacy Class Action Settlement

Goshen Health patients who logged into a Goshen patient portal account between Jan. 1, 2020, and Dec. 31, 2023, may qualify to claim a $25 cash payment and privacy protection from a class action settlement.

Goshen Health System Inc. agreed to settle a class action lawsuit alleging it disclosed confidential personally identifiable information and/or protected health information to third-party technologies without patient consent.

Who is eligible to file a claim?

Class members may file a claim if they meet all of the following criteria:

• They were a patient of Goshen Health residing in the United States.
• They had a Goshen Health patient portal account.
• They logged into that account between Jan. 1, 2020, and Dec. 31, 2023.

How much can class members receive?

Eligible class members who submit a valid claim can claim a cash payment of $25. In addition, all class members will receive a code to enroll in Privacy Shield Pro, which offers privacy protection services.

The settlement agreement specifies that Goshen Health will pay all approved claims so the $25 payment is not subject to proration.

How to claim a settlement payment

Class members can file the online claim form or download, print, complete and mail the PDF claim form to the settlement administrator.

What information is necessary to submit a claim?

To file an online claim, class members must log in with the notice ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@GoshenHealthPrivacySettlement.com or calling 833-417-4915 and providing their full name and mailing address.

Settlement fund breakdown

The settlement fund includes:

• Settlement administration costs: To be determined
• Attorneys' fees, costs and expenses: Up to $204,151.20
• Service awards to class representatives: Up to $3,500 each ($7,000 total)
• Privacy Shield Pro costs: Dependent on number of valid claims
• Payments to eligible class members: $25 per approved claim

When is the Goshen Health privacy settlement payout date?

The settlement administrator will issue payments to eligible class members within 14 days after the court grants final settlement approval.
