Who can file a claim?

Class members must meet the following criteria:

  • They are a United States resident whose private information the December 2023 data breach at Greater Cincinnati Behavioral Health Services impacted.
  • They received direct notice of the data incident from GCBHS or the settlement administrator.

The impacted information includes :

  • Names
  • Dates of birth
  • Social Security numbers
  • Driver’s license or state identification numbers
  • Health insurance policy or plan numbers
  • Health care information, such as Medicare/Medicaid numbers, patient identification numbers, medical record numbers, provider names, treatment locations, dates of treatment, diagnoses, treatments, prescriptions, medical histories and test results

There are approximately 61,850 class members.

How much can class members get?

Class members may be eligible for three types of relief and can claim all three if they qualify:

  • Out-of-pocket loss reimbursement: All class members can claim actual documented losses or expenses resulting from the data incident. Eligible expenses include:
    • Unreimbursed costs, expenses, losses or charges due to identity theft, identity fraud or misuse of their Social Security number
    • Unreimbursed costs associated with accessing or freezing/unfreezing credit reports with any credit reporting agency after December 2023
    • Miscellaneous expenses such as notary, postage, copying and mileage
    • Other mitigative costs fairly traceable to the data incident and incurred after December 2023
    • Unpaid time off work to address issues related to the data incident at their actual hourly rate
  • Cash payment: All class members can claim a cash payment regardless of whether they suffered out-of-pocket losses. The estimated range is $60.90 to $131.48, but the actual amount will depend on the number of claims and the amount remaining in the settlement fund after other expenses.
  • Identity theft and credit monitoring: All class members can claim one year of CyEx Medical Shield three-bureau identity theft and credit monitoring protection.

How to claim a data breach payout

Class members can submit the online claim form or download, print and complete a PDF claim form (Page 45 of the settlement agreement) to mail to the settlement administrator. The claim deadline is Dec. 11, 2025.

What proof or documentation is necessary to submit a claim?

  • All class members must provide the unique ID located on the postcard notice they received. Online claimants must also provide the PIN from the same notice. Those who lost or misplaced their notice should contact the settlement administrator at info@GCBDataSettlement.com and provide their full name and mailing address.
  • To claim reimbursement for out-of-pocket losses, class members must provide documentation, such as receipts or other nonhandwritten records, and a brief description of the loss to support their claim.
  • To claim the cash payment and/or credit monitoring, class members need only select the appropriate box.

All checks will expire and become void 180 days after issuance.

$850,000 settlement fund breakdown

The $850,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $283,333.33
  • Attorneys’ expenses: Up to $30,000
  • Service awards to class representatives: Up to $5,000 for each of the two representatives ($10,000 total)
  • Payments to eligible class members: The remainder of the fund

When is the Greater Cincinnati Behavioral Health Services data incident settlement payout date?

The settlement administrator will distribute payments after it completes any appeals or reviews and the court grants final approval.
