Consumers who received a notice stating the May-June 2024 Fraser Child and Family Center data incident compromised their private information may qualify to claim a cash payment and other benefits from a class action settlement.

Fraser Child and Family Center agreed to pay $725,000 to resolve a class action lawsuit alleging a cyberattack on its computer systems exposed sensitive personal information, including names, Social Security numbers, dates of birth, addresses and medical information.

Who can file a claim?

The class includes:

  • Anyone in the United States whose private information the May-June 2024 Fraser data incident compromised
  • Anyone who received a notice letter from Fraser regarding the data incident

There are are approximately 64,127 class members. The class includes both adults and minors and is not limited to those who suffered financial loss.

How much can class members receive?

Each class member may select one payment option and one credit monitoring option.

  • Credit monitoring services
    • CyEx Identity Defense Complete (for adults): Includes two years of real-time credit file monitoring, high-risk transaction monitoring, dark web monitoring and $1 million in identity theft insurance.
    • CyEx Minor Defense (for minors): Provides two years of identity monitoring for Social Security numbers in credit files, public records tracing and dark web monitoring.
  • Payment options
    • Documented losses payment: Up to $2,500 for actual, documented out-of-pocket losses related to the data incident. Eligible expenses include:
      • Losses from identity theft or fraud
      • Fees for credit reports, credit monitoring or freezing/unfreezing credit
      • Costs to replace IDs
      • Postage to contact banks by mail
  • Cash payment: Those who did not suffer or do not wish to claim documented losses may opt for a cash payment. The total amount available for cash payments is the remaining balance of the settlement fund after deductions for attorneys’ fees, service awards and administrative costs. The claims administrator will divide this amount equally among all claimants who choose this option.

How to claim a class action payment

Class members can file a claim online or download and print a PDF claim form, complete it and mail or email it to the settlement administrator. The claim deadline is Dec. 1, 2025.

What proof or documentation is necessary to submit a claim?

  • To file an online claim, class members must log in with their unique ID and PIN, which is located on then notice they received from the settlement administrator. Those who are unable to locate their ID and PIN should contact the settlement administrator at info@FraserDataSettlement.com and provide their full name and mailing address.
  • To claim a documented losses payment, class members must provide documentation of the loss. Acceptable documentation includes bank statements, receipts or other third-party records showing the amount spent or lost due to the data incident. Personal notes or self-made papers may supplement but not replace third-party documentation.
  • To claim a cash payment or credit monitoring, class members need only select this option on the claim form.

$725,000 settlement fund breakdown

The $725,000 settlement fund covers.

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $241,642.50
  • Service awards to class representatives: $4,000 each for six representatives ($24,000 total)
  • Payments to eligible class members: Remaining funds

If any money is left in the net settlement fund 150 days after the settlement administrator sends payments to class members (due to uncashed checks), the administrator may distribute an additional payment to all approved participants who received and/or cashed their first payment as long as the average additional payment is at least $3. If the average payment would be less than $3, the administrator will distribute the remaining funds to the cy pres designee, Mid-Minnesota Legal Aid.

When is the Fraser Child and Family Center settlement payout date?

The settlement administrator will issue payments to eligible class members after it resolves appeals and the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged a cyberattack on Fraser’s computer systems in May and June 2024 resulted in unauthorized access to files containing sensitive personal information. The plaintiffs claimed this breach exposed names, Social Security numbers, dates of birth, addresses and medical information.

Fraser denies any wrongdoing, but both sides agreed to settle to avoid the costs, risks and uncertainties of continued litigation and to provide benefits to those affected.
