
Employees who used an iT100 face time clock while assigned to or working at Troy Design & Manufacturing Co.’s Chicago modification center between Nov. 29, 2022, and April 5, 2023, may qualify to receive an estimated $582 from a class action settlement.
Troy Design & Manufacturing Co. and its staffing vendor PeopleShare agreed to pay $212,500 to resolve a class action lawsuit alleging the companies violated the Illinois Biometric Information Privacy Act by collecting biometric data using a face-scan time clock without obtaining consent or providing a written retention policy.
Who are the class members?
Class members must have used the iT100 face-scan time clock device while assigned to or working at Troy Design & Manufacturing Co.’s modification center in Chicago, Illinois, at any time between Nov. 29, 2022, and April 5, 2023.
If an individual received a notice about this settlement, it is because PeopleShare’s records indicate they are likely a class member.
How much can class members get?
Pro rata payment: The total settlement fund is $212,500. After deducting notice and administration costs and the class representative’s service award, the settlement administrator will distribute the remainder equally among all class members who do not opt out.
Each eligible class member is expected to receive a cash payment of approximately $582. If fewer people participate in the settlement, the per-person amount increases; if more participate, the amount decreases. Attorneys' fees and costs do not affect class member payments.
If any checks are not cashed after 120 days, the settlement administrator will redistribute the funds on a pro rata basis to those who cashed their initial checks as long as the amount to be distributed is at least $10 per person after costs.
If the remaining funds are less than $10 per person or if checks from the subsequent distribution remain uncashed, the settlement administrator will donate funds to a charitable organization subject to court approval.
No action needed to receive payment
Class members do not need to file a claim to receive payment. The settlement administrator will use Troy Design & Manufacturing Co.'s records to send payments automatically to the last known address of each class member.
Those who moved or need to update their address should do so via the online form or by sending it via mail to the settlement administrator.

Class members who need to change the payee due to a name change must provide legal documentation (such as a marriage license or court order) and a copy of their driver’s license or state ID. If the class member is deceased, the individual should provide a copy of the death certificate and documentation showing they are the legal beneficiary.

The defendants will pay $200,000 in attorneys' fees and costs separately from the $212,500 fund.

When is the Franklin v. Troy Design & Manufacturing Co. payout date?
The settlement administrator will issue payments to eligible claimants approximately 60 days after the court grants final approval of the settlement and resolves any appeals.
