Eye Physicians of Central Florida PLC agreed to settle a class action lawsuit alleging a targeted cyberattack in 2023 exposed sensitive patient information. The plaintiff claimed Eye Physicians did not adequately protect patient data, which led to the breach.

Class members are individuals who received notification from Eye Physicians of Central Florida that he November 2023 data breach impacted their private information.
How much will settlement payments be?
Class members have the following benefit options:
- Documented ordinary losses: Class members can claim up to $2,000 for documented out-of-pocket expenses traceable to the data breach. This also includes up to three hours of lost time at $25 per hour for efforts to resolve issues related to the breach. Other eligible expenses include bank or credit card fees, fees for credit monitoring or identity theft insurance and postage for communication with financial institutions.
- Documented extraordinary losses: Class members can claim up to $7,500 in documented unreimbursed monetary losses due to fraud or identity theft resulting from the data breach. Claimants must have exhausted all other available insurance or reimbursement options.
- Credit monitoring services: All class members can elect to receive two years of one-bureau credit monitoring services, which include $1 million in identity theft insurance.

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail or email to the settlement administrator.

- Ordinary losses claims require supporting documentation, which may include receipts, invoices and a description of lost time spent dealing with the data breach.
- Extraordinary losses claims require supporting documentation which may include bank or credit card statements showing unreimbursed fraudulent charges, police reports, communication with financial institutions and other proof of fraud or identity theft along with evidence that the class member exhausted all insurance or reimbursement options.
