Individuals who worked as a nonexempt hourly employee for Sterling Farm & Fleet Inc. or Blain Supply Inc. and received a sales incentive bonus or weekend premium pay while working more than 40 hours in a workweek between Jan. 1, 2022, and Dec. 31, 2025, may be eligible to claim a cash payment from a class action settlement.

Sterling Farm & Fleet Inc. and Blain Supply Inc. agreed to pay $71,939.50 to resolve a class action lawsuit alleging they failed to properly include certain types of nondiscretionary compensation, such as sales incentive bonuses and weekend premium pay, when calculating overtime rates. The plaintiff claimed this resulted in the company underpaying overtime wages in violation of federal and state wage laws.

Who are the class members?

The settlement applies to individuals who:

  • Worked as nonexempt hourly employees for Sterling Farm & Fleet Inc. or Blain Supply Inc.
  • Worked more than 40 hours in a workweek between Jan. 1, 2022, and Dec. 31, 2025
  • Received either a sales incentive bonus or weekend premium pay during that workweek

There are two categories of class members:

  • Rule 23 class (state law claims): All individuals who meet the criteria above and do not opt out of the settlement. These class members do not need to take action to be included in this group. The rule 23 class covers claims under state wage-and-hour laws.
  • Collective class (federal law claims): Individuals who meet the same criteria as the Rule 23 class but who also submit a consent to join form by June 11, 2026. The collective class covers claims under the federal Fair Labor Standards Act.

How much can class members get?

The total settlement fund available for distribution to class and collective members is $34,119.50. The amount each class member receives depends on several factors, including:

  • The number of eligible workweeks in which the employee worked overtime and received a sales incentive bonus or weekend premium pay
  • Whether the individual joins only the Rule 23 class or both the Rule 23 and collective classes
  • The total number of participating class members

The settlement administrator will calculate each class member’s payment based on payroll records, reflecting the number of qualifying workweeks and the type of compensation received. The more eligible weeks an employee worked, the larger their share of the settlement.

How to receive a class action payment

Rule 23 class members who do not wish to join the collective class do not need to take any action to receive their payment. If they do not opt out, the settlement administrator will mail their check after the settlement receives final approval.

Those who wish to join the collective class and receive additional compensation for federal claims must download, print and complete the consent to join form and mail, fax or email it to the settlement administrator by June 11, 2026.

When is the Enderson v. Sterling Farm & Fleet payout date?

The settlement administrator will mail payments to eligible class members approximately 30 days after the court resolves any appeals and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit claimed Sterling Farm & Fleet Inc. and Blain Supply Inc. failed to include certain types of pay, such as bonuses and weekend premium pay, in their calculations of overtime wages. This allegedly violated the Fair Labor Standards Act and state wage laws.
