Individuals who received a notice that a June 2023 Valley Oaks Health Inc. data incident exposed their private information may be eligible to claim up to $5,580 from a class action settlement.
Valley Oaks Health agreed to settle a class action lawsuit alleging a targeted cyberattack that occurred between June 8, 2023 and June 13, 20223, potentially exposed sensitive personal and medical information. The information included names, dates of birth, Social Security numbers, medical diagnosis and clinical information, driver's license or state identification numbers, financial account information, such as credit or debit card numbers with security codes, biometric data or DNA profiles and usernames or email addresses in combination with a password or access code.
Who can file a claim?
Class members are all individuals whose private information the June 2023 Valley Oaks Health data incident potentially compromised and whom the settlement class list the settlement administrator maintains includes.
How much are settlement payments?
Class members have the following benefit options:
- Cash payment for out-of-pocket losses: Class members can claim up to $500 for documented out-of-pocket expenses due to the data breach. Eligible expenses include credit monitoring fees, costs to replace IDs and postage to contact banks.
- Cash payment for extraordinary out-of-pocket losses: Class members who experienced identity theft or fraud as a result of the incident may claim up to $5,000.
- Reimbursement for lost time: Class members who spent time responding to the incident may claim up to four hours of lost time at $20 per hour for a maximum of $80. This includes activities such as changing passwords or investigating suspicious activity.
- Alternative cash payment: Class members who do not have or do not wish to provide required proof for the above options may claim a one-time $40 cash payment.
- Medical monitoring services: All class members are eligible for two years of CyEx Medical Shield Pro, which includes $1 million in medical identity theft insurance and monitoring for health care insurance ID exposure, medical record number exposure and unauthorized health savings account spending. If the program detects suspicious activity, fraud resolution support is available.
How to claim a class action rebate
To receive compensation, class members can submit the online claim form or print and complete the PDF claim form and mail it to the settlement administrator. Claimants can aslo request a paper claim form by contacting the settlement administrator.

- For online claims, class members must provide the login ID and PIN from the settlement notice they received.
- For ordinary out-of-pocket losses, class members must provide receipts, statements or other documentation showing the expense or loss was related to the data incident. Self-prepared documents are insufficient to receive reimbursement, but class members may submit them to add clarity or support to other submitted documentation.
- For extraordinary out-of-pocket losses, class members must provide receipts, statements or other documentation showing the data breach most likely caused the loss, that ordinary reimbursement does not cover it and that they attempted to recover the loss through insurance or other means. Self-prepared documents are insufficient to receive reimbursement, but class members may submit them to add clarity or support to other submitted documentation.
- For lost time, class members must describe the activities they performed and the time they spent but do not need to submit receipts.
- For medical monitoring or the alternative $40 cash payment, no documentation is required.
