
Current and former patients and other individuals who logged into the Duke MyChart patient portal or MyDuke Health mobile app at least once between Feb. 18, 2019, and June 17, 2022, may be eligible to submit a claim for a cash payment from a class action settlement. The settlement class includes approximately 872,634 individuals.
Duke University Health System Inc. agreed to pay $3.74 million to settle a class action lawsuit alleging it improperly disclosed personal and health-related information through tracking tools on its website. The lawsuit claims these tracking tools, including a third-party pixel, may have shared sensitive data with a vendor when patients accessed Duke Health’s online services.
Who can file a claim for a MyChart payout?
Class members are individuals in the United States whom Duke Health identified as having logged into the Duke MyChart patient portal or MyDuke Health mobile app at least once between Feb. 18, 2019, and June 17, 2022.
How much are settlement payments?
Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment from the net settlement fund. The settlement administrator will determine the final payment amount by the total number of claims filed.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or print a PDF claim form to complete and mail to the settlement administrator.

When is the Duke University Health System privacy settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 60 days after the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Duke Health used tracking tools on its website, MyChart portal and MyDuke Health mobile app that may have shared personal and health-related information with a third-party vendor. The plaintiff claimed this practice invaded the privacy of patients and class members.
Duke Health denies any wrongdoing but agreed to settle to avoid the expense and risk of continued litigation and a possible trial.
