
Individuals who leased a residential unit in Florida managed by BH Management Services LLC may receive a cash payment or debt relief from a class action settlement if the company withheld part or all of their security deposit without providing proper notice.
BH Management Services LLC agreed to resolve a class action lawsuit alleging violations of Florida’s landlord-tenant and consumer collection laws regarding security deposits.
Who are the class members?
Class members must meet the following criteria:
- They leased a dwelling unit in Florida at a property BH Management Services LLC managed.
- They did not receive a notice that complied with Florida Statute §83.49(3)(a) regarding security deposit withholding.
- BH Management withheld some or all of their security deposit.
There are two groups within the class:
- Security deposit class: Individuals who allegedly do not owe any balance to BH Management or the property owner
- Security deposit balance class: Individuals who allegedly owe a balance to BH Management or the property owner
The settlement administrator already identified class members based on BH Management’s records. Individuals who received a notice regarding this settlement are likely included in one of these groups.
How much can class members get?
- Security deposit class: Members will receive a cash payment equal to 50% of the withheld security deposit.
- The total allocated for this group is $541,528.
- Security deposit balance class: Members are eligible for up to 50% of the withheld security deposit, but this amount is first applied as debt relief against any balance owed to BH Management up to three times the 50% amount.
- The total allocated for this group is $31,323.66 in cash and $419,178.47 in debt relief.
No action necessary to receive payment
Class members do not need to file a claim to receive their payment or debt relief. The settlement administrator will automatically issue payments and debt relief after the settlement receives final court approval using BH Management's most recent contact information.
Class members who wish to update their contact information must log in to the website using the notice ID and PIN from their settlement notice.
Settlement fund breakdown
The settlement fund will cover:
- Settlement administration costs: To be determined
- Attorneys’ fees: $396,148.34
- Attorneys’ expenses: $21,000
- Class representative service award: $10,000
- Payments to security deposit class members (cash): $541,528
- Payments and debt relief to security deposit balance class: $31,323.66 (cash) and $419,178.47 (debt relief)
The settlement administrator will donate any uncashed checks or remaining funds 90 days after distribution to Legal Services of Greater Miami.

The settlement administrator will issue payments after the court grants final approval and resolves any appeals.
Why is there a class action settlement?
The class action lawsuit alleged BH Management Services LLC failed to provide tenants with the required notice under Florida law before withholding security deposits. The plaintiff claimed this violated the Florida Residential Landlord Tenant Act and the Florida Consumer Collections Practices Act.
BH Management denied any wrongdoing but agreed to settle to avoid further litigation and costs.
