Individuals who lived in the United States and whose workers’ compensation audit file, which included their unredacted Social Security number, the October 2023 Brodart Co. data breach potentially compromised may be eligible to claim up to $2,500 from a class action settlement.

Brodart Co. agreed to resolve a class action lawsuit alleging a targeted cyberattack on its computer systems in October 2023 led to unauthorized access to files containing sensitive personal information. The lawsuit claimed the breach exposed details such as:

  • Names
  • Addresses
  • Dates of birth
  • Social Security numbers
  • Government-issued identification numbers
  • Financial account information
  • Credit or debit card numbers with security codes
  • Phone numbers
  • Medical information

Who can file a claim?

The class includes all individuals residing in the United States whose workers’ compensation audit files containing their unredacted Social Security numbers the data breach Brodart Co. discovered in October 2023 compromised.

How much can class members receive?

Class members can claim any of the following:

  • Out-of-pocket expenses: Up to $1,000 for documented expenses incurred as a result of the breach that occurred between Oct. 14, 2023, and May 7, 2026. Eligible expenses include fees for credit reports, credit monitoring, freezing/unfreezing credit and replacing IDs and postage to contact banks. Receipts or other documentation are required.
    • Lost time: Up to four hours of lost time at $20 per hour (maximum $80) for activities such as changing passwords, investigating suspicious activity or researching the breach. Class members must provide a brief description of the activities. This amount counts toward the $1,000 out-of-pocket cap.
  • Losses for identity theft or fraud: Up to $2,500 for documented monetary losses resulting from identity theft or fraud that the breach likely caused and are not already covered by out-of-pocket expenses. Class members must show they tried to recover losses (e.g., through insurance). Receipts or supporting documentation are required.

Those who do not claim out-of-pocket expenses, lost time or losses for identity theft or fraud can claim an alternative cash payment of $45. No documentation is required for this option.

All class members can claim credit monitoring services, including one year of credit monitoring from all three credit bureaus, $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning, public records monitoring and access to fraud resolution agents.

How to claim a settlement payment

Class members must file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator. They may also request a paper claim form by calling 833-647-9035 or emailing info@BrodartDataSettlement.com. The claim deadline is May 8, 2026.

What proof or documentation is required to submit a claim?

  • Online claims require the unique ID and PIN from the settlement notice the class member received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@BrodartDataSettlement.com and providing their full name and mailing address.
  • Out-of-pocket expense claims require receipts or other proof of payment.
  • Identity theft or fraud loss claims require documentation showing the loss and its connection to the breach.
  • Lost time claims require a brief description of the tasks performed.
  • Alternative cash payment claims do not require documentation.

Payout options

  • Class members who submit their claim online may choose digital payment via PayPal, Venmo or Zelle.
  • Class members who submit their claim by mail will receive a paper check mailed to their address.

Settlement fund breakdown

The settlement fund will cover:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: $105,000
  • Service award to class representative: $3,000
  • Payments to class members: Remaining funds
