Consumers who purchased Breckenridge duloxetine (generic Cymbalta) in the United States for personal or household use between Aug. 4, 2020, and May 22, 2025, may be eligible to claim between $5 and $10 per prescription from a class action settlement.

Breckenridge Pharmaceutical Inc. agreed to settle a class action lawsuit alleging it sold duloxetine containing n-nitroso-duloxetine, a nitrosamine impurity. The plaintiffs claimed this impurity can cause cancer under certain circumstances and that its presence made the product unlawful to sell and economically worthless.

Who can file a claim?

Class members must meet all of the following criteria:

  • They are a natural person (not a business or other entity).
  • They purchased Breckenridge duloxetine in the United States.
  • They purchased duloxe for personal or household use.
  • The purchase occurred between Aug. 4, 2020, and May 22, 2025.
  • They paid some out-of-pocket cost for their prescription. Those whose insurance covered the entire cost and paid nothing are not eligible for compensation.

How much is the generic Cymbalta payout?

There are three main categories of class members, depending on their purchase and recall status:

  • Those who purchased Breckenridge duloxetine during the eligible period that was not recalled may claim a single payment of $5.
  • Those who purchased Breckenridge duloxetine during the eligible period that was recalled before May 22, 2025, may claim a single payment of $7.50.
  • Those who purchased Breckenridge duloxetine during the eligible period that was recalled before May 22, 2025, and were unable to use it due to the recall may claim $10 per such prescription.

Class members can only claim one of the three payment options. For example, those who bought three prescriptions and had two that were recalled but only one was not used due to the recall could claim $10 for the unused prescription and $7.50 for the other recalled prescription. However, they may only select the highest eligible tier. Thus, they would receive $10.

Those who paid more than $5, $7.50 or $10 per prescription can still only receive those amounts.

How to claim a settlement payment

Class members can file a claim online or print out, complete and mail the claim form from the same link. They may also request a paper claim form from the settlement administrator.

Those claiming unused medication will receive instructions and a shipping label to return the product to a separate address. Do not mail the medication to the administrator’s address above.

Is proof or documentation required to submit a claim?

Yes. Claimants must provide documentation to support their claim. Required proof includes:

  • Proof of purchase of Breckenridge duloxetine (such as a pharmacy receipt, insurance or pharmacy benefits manager records or other pharmacy records)
  • If claiming the $7.50 or $10 tier, documentation showing the prescription was subject to a product recall (such as pharmacy documentation of the lot number or documentation of the pharmacy, NDC and expiration date that matches recalled lots)
  • If claiming $10 per prescription, return of the unused medication or a signed certification (under penalty of perjury) that they were unable to use the medication due to the recall

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: To be determined
  • Service award to class representative: Up to $1,500
  • Payments to class members: $5, $7.50 or $10 per eligible claim, depending on documentation

When is the Breckenridge duloxetine settlement payout date?

The settlement administrator will distribute payments after the court resolves any appeals or motions and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Breckenridge Pharmaceutical Inc. distributed duloxetine containing NDLX, a nitrosamine impurity that could pose a cancer risk. The plaintiffs claimed the presence of this impurity made the product unlawful to sell and economically worthless, causing financial harm to purchasers.

Breckenridge denied these allegations but agreed to settle to avoid the cost, risk and delay of further litigation.
