Berman & Rabin P.A. agreed to pay $980,000 to settle a class action lawsuit alleging it failed to safeguard personal information during a cyberattack in July 2024.
Who can file a claim?
Class members are eligible to participate in this settlement if they are a living individual in the United States who received a notice that the July 2024 Berman & Rabin data incident potentially compromised their private information.
How much can class members get?
- Documented losses payment: Up to $3,500 for actual, documented, unreimbursed out-of-pocket losses related to the data incident. Eligible expenses include losses due to identity theft or fraud, fees for credit reports or freezing/unfreezing credit, costs to replace IDs and postage to contact banks. Proof, such as receipts, is required.
- Alternate cash payment: A one-time pro rata cash payment for class members without documented losses. The settlement administrator will calculate the amount by dividing the net settlement fund by the number of valid claims. No documentation is required for this payment.
- Credit monitoring: Two years of CyEx Financial Shield Complete credit monitoring, which includes $1 million in financial fraud insurance and monitoring for identity theft, unauthorized financial transactions and high-risk activity.

Class members can file a claim online or download and print a PDF claim form and mail it to the settlement administrator.

Proof and documentation necessary to submit a claim
- For the documented loss payment, claimants must provide proof, such as receipts or other documentation, showing the data incident caused the expenses. Personal certifications, declarations or affidavits are not sufficient alone, but class members may include them to provide context or support for other documentation.
- For the alternate cash payment or credit monitoring, claimants do not need to provide proof but must select the appropriate option on the claim form.

When is the Berman & Rabin data incident settlement payout date?
